UPDATED: Georgia On My Mind

Shipwreckedcrew has a very perceptive article that begins by discussing general electoral litigation issues and then focuses specifically on Georgia: What is the End Game for the Litigation Strategy In Georgia?

As regards the general issues, SWC warns us to expect reversals at the lower court levels:


Let’s begin with a simple observation — no single district court judge and no three-judge panel of a federal circuit court of appeal are going to enter an order that reverses the outcome of a state’s reported vote count with regard to selecting the electors who will choose a President. Doing so would run contrary to the long-standing principle of not involving the Judicial branch in the outcome of disputes of a political nature involving the two political branches.

Lower courts will conduct hearings and received factual evidence, but at the end of the process, it is almost a certainty that they will decline to exercise any authority to intervene — even in cases of fraud.


He goes on to explain why this is so, why you should expect these outcomes. It's part of the process that the Trump team hopes will get them to the SCOTUS--as Jordan Sekulow also makes clear in an interview that I'll link below. Be prepared, and if you want more information, follow the link above.

After this discussion, SWC moves on to Georgia. His bottom line is that the Trump team needs to get a machine recount--which they're entitled to. However, along the way to that conclusion, he uncovers some eye catching statistical anomalies that came to light in the just completed recount. Basically, what he shows is that:

1. In the heavily Dem counties in the Atlanta metro area--won by Biden in overwhelming fashion--the recount discovered new votes.

2. Logically you would expect those new votes to break in the same ratios as the votes that had already been counted.

3. Instead, in stunning fashion, the ratios actually reversed, with Trump winning the newly discovered votes in equally overwhelming fashion!

I'll let SWC explain it. First he gives the readout from the four counties. I've edited this for clarity:


Fulton (73% Biden):  634 new votes; +345 net vote gain for Trump

Gwinnett (58% Biden): 1642 new votes; +285 net vote gain for Trump

Clayton (85% Biden):  260 new votes; +145 net vote gain for Trump

Rockdale (70% Biden):  6 FEWER votes; +241 net vote gain for Trump


Clearly these results fly in the face of all the odds. Something funny had to have been going on.

Now, here's another way to look at those numbers--again edited for clarity--to make those results really jump out:


For that math to work, that means that Fulton County--which voted 73% for Biden--added 489 Trump votes, and 145 Biden votes.

In Clayton County--which voted 85% for Biden--the recount produced 360 new votes. Those new votes broke 252 to 107 in favor of Trump over Biden--70% to 30% for Trump over Biden.

Rockdale--which went 70% for Biden--actually LOST 6 votes, yet Trump’s vote total increased by 241 votes!  The only way that makes sense is if Biden votes from the election tally became Trump votes in the recount.  

Gwinnett--which voted 58% for Biden--ended up with 1642 additional votes. Trump gained 285 votes.  The math says the 1642 new votes broke 963 to 679 in favor of Trump. That almost exactly reversed the ratio--with Trump winning new votes at a rate of 59% to 41%.

The other three metro-Atlanta counties ended up with more Biden votes, but in percentages that still meant that Trump overperformed in the recount compared to the election tally.


Now here's the 12 minute video of Jordan Sekulow being interviewed regarding the Trump legal strategy. Sekulow doesn't beat around the bush. It's clear that the goal is to eventually amalgamate the contested states into one case that can get to the SCOTUS--confirming in its own way SWC's observations, above. Also note that Sekulow explicitly distinguishes these challenges regarding "voter fraud" from the ongoing efforts of Sidney Powell regarding systematic "election fraud." UPDATE: I should've trusted my instincts. When I first wrote this thread I wanted to predict that the lawsuit that Trump hinted at this morning would include allegations that the fraudulent election was enabled by kickbacks from Dominion to the Republican governor and Secretary of State--Sidney Powell has been suggesting that openly for days, now. The idea would be that, in exchange for the kickbacks they would adopt a more or less hands off approach during elections. Then I thought, no, you can't go that far. But here we are. Powell stated on Newsmax:


Georgia is the first state I’m going to blow up. And Mr. Kemp and the Secretary of State need to go with it because they’re in on this Dominion scam with their last minute purchase!


It sure sounds like she's gonna go there.

  1. I have written it many times- the road to victory is recounting the mail in votes, but with real signature matching.

    The Biden ballots exist- maybe not on election night, but they do now. The hand recount confirmed this in Georgia, and I imagine a similar recount anywhere else will show the same thing.

    If I were on Trump's team, I would be contacting every single mail-in ballot person I could between now and the end of the month asking them directly, "Did you request and return a ballot by mail?" Your fraud is right there- the Democrats hoovered up the excess ballots whereever they could do so, filled them out, and returned them. They are probably still doing it, and they will do it again in the runoff elections.

  3. Hindsight is 20/20, but I wish that at the first sign of ballot counting stoppage, Trump had sent in the US Marshals to the polling centers to keep things on the up and up. Two GOP candidates had won, then lost, California house races in 2018. The efficacy of this approach was not lost on the Dems, who set out to repeat in on a national scale in 2020.

    2. Sometimes the best way to beat an opponent is to use their own playbook against them. In this case, the Trump Admin might make a big production claiming that minority voters in these Blue cities that mysteriously saw 110% turnout are being disenfranchised contra the Voting Rights Act due to a nefarious scheme by "unknown" villains seeking to flood these areas with phony ballots and electronic manipulation. Afterall, it must be racism if it only seems to happen in these urban areas, right? Well, then, time to send in the FBI and DOJ to open emergency investigations with grand juries and the works, subpoena the heck out of all these racist election officials, Dominion execs, et al who are trying to take away the votes of minorities. We won't stand for it, says Trump. In fact, we're looking into possible racist collusion by Kemp and others who refuse to ensure black voters are not defrauded of their legal votes. You get the drift. How do Democrats and media ignore a high profile investigation against racist election officials? But it's not theater. It's a serious investigation that could blow the thing wide open when jail time is threatened.

      That's the damn thing about cognitive dissonance and why we humans struggle so much with it and its consequences.

      The default position which we are all taught to believe is that the two political parties are rock solid representatives of the American Constitutional idea. The Democrats, we are taught, are the inheritors of a great political tradition handed down from FDR to JFK to Barack Obama, and are the party of the working class and the party of minorities.

      Despite all of the evidence staring us right in the face. The Democrat party is now a party of the Elites. It is now the party of Wall Street, the Ivy League, Silicon Valley, the Defense Industry, Hollywood, the New York Times and the Deep State. It is the party of the Technocracy, the Professoriate and the Plutocracy.

      They simply are not the party of the working class or of minorities.

      To suggest that the actions of Democrat election officials to put their collective 'fingers on the scale' in Philadelphia, Detroit or Atlanta were to benefit the populations of those cities is utterly disingenuous. It is also racist, in the sense that election fraud in urban cities disenfranchises the residents of those cities, while effecting the accretion of power to the Elites.

      Thus...the pesky cognitive dissonance which is afflicting us.

At any rate, I, for one, am firmly convinced that the party of slavery and Jim Crow have never abandoned their racist roots, their rhetoric to the contrary notwithstanding. As i say in my comment, the DOJ bringing Voting Rights cases is not mere theater. It is a serious, even deadly issue. My point was simply to frame it so that Democrats are hard pressed to argue against it or impede it.

  4. What intrigues me is that for Powell to know this, and be able to make he allegation in a lawsuit, she needs banking records or something similar to document the kickback payments.

    She can't subpoena bank records, so that's not how she got this. I'm guessing she has a whistleblower from inside Dominion who copied internal documentation showing the kickback payments to politicians.

    That would explain why Dominion company officials are running around trying to disappear, refusing to testify in legislative hearings in PA, and closing up their offices in the US and Canada. These kickbacks are crimes that have been committed, and they can be prosecuted. Care to guess how fast they would roll over and sing on whoever hatched this scheme if offered a plea deal?

    I strongly advise Dominion Voting Systems officials to avoid hiking alone in Ft. Marcy park.

    2. Perhaps that is why Ms. Powell mentioned the witness protection program for some of her witnesses. When there are powerful individuals with everything to lose, desperate measures become more reasonable.

      If Trump and Ms. Powell (and others) succeed in exposing the rotten underbelly of election fraud, it will be a new day in America. And what affect will this have on our worthless media, already shamed by the Russia Hoax, sham impeachment, helping to hide Hunter Biden's debauchery, selling Biden as the 'president-elect,' calling elections before 1% of the vote is counted, etc.? There should be a reckoning for the evil and partisan fourth estate.

When she says (I forget which interview) That Patriots are coming forward now because they trust Sidney and Guliani and Wood will see it through and that too many times before people have come forward to report evidence of nefarious activity but the government wouldn't do anything about it or honor their claims, that sounds totally credible to me. I think the press conference was way more about convincing more, probably certain people to flip. She showed just enough of what they know to signal to fraudster's that they already have some inside info. The counter narrative Tucker Carlson could be trying to reassure / strengthen the spine of would-be flippers that Sidney and team DON'T have anything real yet.

      I can not remember which interview it was but Sidney stated she had an affidavit from a witness in the GA bribery situation with detailed information.

      That of course pulls the pressure off of her and puts it on the witness. But it allows her to dump the tanks on her flame thrower with impunity.

  6. Mail in voting can work with photo Id emailed to the authorities. Not perfect but much better than no id. And yes there are a handful of elderly voters with no cell phone to take a picture. That can be handled as well

In the newsmax interview, SP makes the important but not generally understood point that neither Trump nor Barr have the level of control over DOJ that people imagine( the myth of the all powerful president). This was in response to the question “where is DOJ” if your assertions re fraud are properly evidenced. As soon as something is “ordered” by one of them politics is immediately charged and the results tainted. I personally think we are beyond that point but we shall see. I do know that the US Attorney in Philly has been quite aggressive there before any of the election issues so I am hopeful he is on the case there.
    SWC responds to question re Durham by stating the timing makes no difference now since he cannot finish anything prior to Jan. 20 so it will be up to Biden DOJ
    if that eventuates.

Very legalistic answer in my view and ignores potentially enormous impact on public awareness (or confirmation) of

  8. What seems to be lost in all this conversation is that Dominion tried selling its product to the state of Texas. After examining the equipment, Texas concluded it was ripe for fraud and other manipulation and said "No Thanks" To Dominion!

    2. I read that Texas had turned Dominions voting systems down three times. Dinesh D’Souza has an interesting take on that:

      Dinesh D’Souza cuts through some of the chaff and countermeasures deployed by Tucker Carlson and asks a transparently obvious question: Are U.S. ballot counting machines capable of being manipulated? That baseline question is not dependent on any answer within a court or Trump campaign team filing. That question is simply a matter of investigative journalism finding out… but they are disinterested.

      If the U.S. uses election machinery that is capable of being manipulated, that alone should initiate a serious line of inquiry about why such a function would even be present. Why would any ballot counting machine even need to have a feature to shift votes or change outcomes? The brutally obvious questions sit in the corner of the room like an 800/lb gorilla the media pretend isn’t there.

Tony Shaffer did an interview on this whole subject back in 2019, he was working on some voting security initiative, testifying before state legislatures and trying to get them to go back to paper ballots. He stated point blank that any digital system is vulnerable and that he had seen this in his professional career. It was linked on TGP.

  10. NBC News writes a surprisingly candid obituary for the Democrats. While extolling what they consider to be Biden’s “win”, the great losses their down ticket candidates suffered at all levels tell any thinking person (not these two reporters) that his “win” was a result of fraudulent vote manipulation. Those doing the manipulatiion, too clever by half, didn’t even consider what might happen down ticket that would throw a very bright light on their illegal shenanigans.
    Although that contradiction is not hard evidence, it should attract judicial notice when considered with the whole package...

    2. Dershowitz was pretty circumspect. He admitted numerous times during his Maria appearance that he had not seen any of the evidence. Thus his opinions were general in nature based upon what he’d heard and how difficult he thought it might be for them to get it done in time. He was more law professor than litigator, and Maria - quite shrill - kept trying to cut him off.

    President Donald Trump’s campaign on Sunday appealed the dismissal of its election lawsuit in Pennsylvania, according to a notice filed in federal court, bringing the campaign one step close to its stated goal of getting an election challenge to the Supreme Court.

    District Court Judge Matthew Brann dismissed the campaign’s lawsuit on Saturday, opining that the plaintiffs lacked standing to bring the claim, among other issues. The campaign said it has appealed the ruling to the United States Court of Appeals for the Third Circuit.

  18. In terms of the “team”, no one seems to be in charge. His background notwithstanding, Rudy has become more of a personality. A celebrity. There is another team lead by Jordan Sekulow that is filing suit in Georgia tomorrow or Tuesday on “constitutional issues”. It is possible to panic unnecessarily when we exist in a world of ignorance about how this project is being handled - who is doing what? Who is steering? Maybe we’ll find out. It did seem that Jenna’s announcement was not as diplomatic as it could (should) have been.
