Virginia Rule Allowing Late Ballots Missing Postmark Was Illegal, Court Rules


The rule was proposed for the 2020 election, but blocked by the judge. Now it has been permanently excluded:


Virginia Circuit Court Judge William Eldridge ruled the state’s late mail-in ballot law violated state statute and permanently banned the law in future Virginia elections, ...


More accurately, the judge didn't "ban the law." What he did was, he ruled that the law must be followed and banned the rule that violated the clear provisions of the law. 


The board of elections proposed the rule during an Aug. 4 meeting and related guidance was sent to election officials statewide on Aug. 13 informing them of the change. ...

On Oct. 28, one week before the Nov. 3 federal elections, Eldridge blocked the law due to the PILF lawsuit. Virginia was therefore prevented from counting late ballots without postmarks, ...

The court ruling will affect the upcoming November 2021 Virginia gubernatorial and house of delegates elections.


This is what needs to be done across the country to block election fraud by state officials. It's pathetic that it should be necessary, but that's American exceptionalism for you.

    Article includes his full story about the laptops from drop-off on. He took no money ever. Was not even paid for work he did to restore hard drive(s). Resents negative publicity he received….

  2. In response to your post, this is very good news and I agree - as should any American - that this should be done in every state. Loopholes that can be exploited by the likes of Biden Inc. should be sealed off.

  3. Rand Paul had the right idea when he said he was going to go state by state and encourage election integrity reforms and corrections to prevent the same problems of the 2020 election. This has to be a singular focus of the GOP. Nothing else matters more than this.

Forgive my pessimism bordering on cynicism, but Dem election officials around the country brazenly refused to comply with court orders (PA--to keep late mail in ballots segregated from the rest, MI--to allow GOP ballot canvassers to observe at close hand the counting and adjudication processes, etc.). When there are no adverse ramifications for breaking the laws or ignoring a court order, what exactly will election integrity laws accomplish? There were law enforcement officers in MI precincts who threatened to arrest accredited GOP poll watchers if they did not vacate the ballot counting areas. How do you overcome blatant lawlessness condoned and even supported by officials and LEOs? And is there anybody left here who doesn't believe that today's FBI/DoJ would sweep the lawlessness of state and local officials under the rug?

      Laws are only as good as those who feel morally constrained to obey them--or enforce them. I'm not sure how we fix things, but I'm quite sure that something far more powerful than laws is required--the will to enforce the law is what is required.

  4. I know it's a pipe dream but out-of-date voter rolls need to be thrown out, and citizens required to register to vote on a new roll using proof of citizenship. The new Compliant driver's license should make it easier to do so, since they require such proof.

  5. Susan rice - told jobama to sign EO thats defines this as illegal voter suppression. People of color are less sell of so they get extra votes. QED
