The Texas GOP Speaks

The speaking was done through a brief statement by the GOP state chairman, Allen West. I like his statement because it highlights the disgrace of the SCOTUS summarily refusing to give a hearing to the concerns of a substantial portion of the nation about the fundamental state of our constitutional order. By this disgraceful refusal to even listen to these concerns the SCOTUS has delegitimized itself and the Constitution itself. If the SCOTUS refuses respectful requests for remedies to clearly unconstitutional actions involving presidential actions, while opining about frivolous non-constitutional matters like "gender identity," this republic has a bleak future:

Below is Chairman Allen West’s statement regarding the decision by the Supreme Court to dismiss Texas’ constitutionally legitimate and critical lawsuit.

“The Supreme Court, in tossing the Texas lawsuit that was joined by seventeen states and 106 US congressman, has decreed that a state can take unconstitutional actions and violate its own election law. Resulting in damaging effects on other states that abide by the law, while the guilty state suffers no consequences. This decision establishes a precedent that says states can violate the US constitution and not be held accountable. This decision will have far-reaching ramifications for the future of our constitutional republic. Perhaps law-abiding states should bond together and form a Union of states that will abide by the constitution.”

The Texas GOP will always stand for the Constitution and for the rule of law even while others don’t.

“We’ve not gotten any court to judge this (the vote) on its merit.” @DanPatrick of Texas. It is a legal disgrace, an embarrassment to the USA!!!

So, you’re the President of the United States, and you just went through an election where you got more votes than any sitting President in history, by far - and purportedly lost. You can’t get “standing” before the Supreme Court, so you “intervene” with wonderful states that, after careful study and consideration, think you got “screwed”, something which will hurt them also. Many others likewise join the suit but, within a flash, it is thrown out and gone, without even looking at the many reasons it was brought. A Rigged Election, fight on!

The Supreme Court really let us down. No Wisdom, No Courage!

I WON THE ELECTION IN A LANDSLIDE, but remember, I only think in terms of legal votes, not all of the fake voters and fraud that miraculously floated in from everywhere! What a disgrace!

  1. The stable genius is showing the way to respond. Insist on paying attention to the truth and fight for it! This may not immediately bring you victory or even satisfactory results, but ultimately it will. I gave said I would follow him to hell, but the fact is he wouldn't lead me to hell, he is simply inviting anyone who will listen to him to behave honorably. I can do that. We all can do that. And having formed a large enough honor group, the forced of corruption and coercion can be overcome.

    1. It's a choice between a quick and painless death vs. a long and painful one.

      I think one benefit of the latter is to spill the toxic guts of the deep state out into the street, for everyone to see, while wondering how to deal with the mess.

      Generations will have to pass before freedom prevails again. Welcome to to the new medieval ages. Hope Trump's remaining actions may shorten the time to the next Renaissance.

      Asimov wrote the Foundation series based on the "Decline and Fall of the Roman Empire". The purpose of the Foundation was to ease the survival of the civilization after the demise of the Empire. And Hari Seldon was tasked to architect it.

      Hope Trump is as successful as Hari Seldon.

  2. What Texas, Florida or one or two of the other states with strong militias need to do is issue a general call to ready of State Defence Forces.

    I see silly comments posted every where about marshall law, military, "Trump needs to"... It's completely ignorant.

    However a state governor can assemble and ready a state force at whim.

    This is about 50 notches below calling for war but a VERY clear shot across the bow to the federal government of "listen up". It's akin to pulling national troops into multinational training exercises. It also gives the state and it's participants the opportunity to fully assembled, take stock and organize themselves within a legally protected realm.

    Doesn't mean or imply any type of violence. It simply means if we're going to play this game let's posture and note that we do have other legal course of addressing this garbage.

    Trust me when I say the federal portion of our government would completely pee it's self.

      That's my crazy but very legally possible path to standing up.

      Any governor can assemble both regulated (guard) and unregulated (private) forces on their own.

      Again... I am not advocating stupidity. I am advocating it be done to show face and fangs.

      I completely and totally disagree with those whom call for Trump to attempt to activate any portion of Martial Law or military anything. That would be a complete disaster and massive mistake. He would be billed as a tyrant!

      The states however have complete control over their defence forces. By example a governor can call in guard troops, but the president can't.

      My thought is... If a state gave the backing to legally assemble we may well be surprised at both the number of people that jump on board and the absolute fear it would strike into the opposition.

      Again... The expect us to behave as kind law abiding citizens that conservatives are. They do not expect us to get off of the sofa.

      And we NEED to!!!

      I would hate to see both the national and even more so international response to Trump throwing down the insurrection act as a means to quell an election dispute. That's a trap he need not go into. Not to mention there is zero good to be found in using regular military forces on US soil.

      As much as I despise what is going on and where we have fallen I can't support that idea.

      I can however support the idea of states and common people standing up to what is transpiring. That is of course you think the framers and the pesky constitutional ideas of that whole thing are just silly?

    6. DMan, not sure what could be done by calling up those forces, but IMO they could start with some not-so-subtle assertions of sovereignty.

      For example, I would start be standing guard at the border on who to allow into your state or not. Second, I would "expel" non-elected federal officers, and absolutely start with the FBI, ATF, EPA, and a couple others. Next, shut down the offices of some of those agencies, and a great place to start that would be the IRS. Escort any of their minions who are not permanent residents to the airport or border and bid them well.

      And then resume building the wall if you're Texas.

Your state militia solution would be fine if it was simply a question of the federal government overreaching in, say, 2nd Amendment rights. But the current crisis is a war and the very sort of war for which we need a national response, a presidential response.

      Do you, sir, believe that Trump would be a tyrant for invoking the 14th Amendment or Insurrection Act? Your remark that such an act for a mere "election dispute" is farcical. Or you haven't been paying attention. This is a war involving outside powers and agents. If the President fails to defend the nation against this assault it's a dereliction of duty. Stare militias may well have a key role to play, particularly in keeping the peace outside the cities but the US military is going to be needed to stop the overthrow of our republic.

      "Major" no, just your usual rumblings out of texas state representatives about "secession"... It's a fun word I'll admit and I've thrown it out there myself. However in researching that it's a dead end according to a USSC decision in 1868 Texas vs White. Apparently the federal governments interpretation is you can be voted into the Union but you can NEVER depart it!

      I wonder how our founders ever wrote that beautifully worded letter of independence to King George III if they didn't agree with splitting up unions?

      I'm hopeful that with our options narrowing we can have a more constructive conversation on what "We The People" can actually do under a state(s) besides pound salt and complain.

      I think calling up forces works the same as NATO drills. Yep it's a training mission and yep our opposition is noticing there's a serious force in play.

      Part of what I am playing heavily off of here is something Mark and others noted about the USSC decision on Texas yesterday. Which is basically were now all islands by their account. Ok so, get off our island seems like it would be a proper response.

      Much of what you are citing on foreign Interference has yet to be proven beyond piles of speculation. So far what we have seen is a domestic election issue and untill I see the DNI say otherwise that's what I'm banking on.

      Regardless of that, my money also says at no point in time is Trump going to cite the 10 U.S. Code § 252-255 and bring in the US military. I believe he is more intelligent than that.

      Also, thanks for questioning my loyalty, Intelligence patriotism and calling me a hypocrite. I'd be offended if I found you worth having an opinion of but please know that I don't.

    10. @tschifty and @devilman, can I suggest a duel?, say pistols at 50 paces? Too old-fashioned? Or does your comment spat amount to an attempt to appeal to each other's honor in a place where such an honor system does not currently exist? I would politely suggest (although what recourse do we really have to politeness anymore as politeness really has no meaning without honor) that neither of you back down and continue to uphold your honor, it would do us all some good to follow the example of our President and "fight", "never give up" and "never give in" but also be prepared at all times to back up one's claims, not to say with your life but with your honor.

      I'm completely ok with respectfully debating any subject. I am very good with also humbly apologizing and admitting when I am wrong or being called out on it.

      That is how we learn, if we are honest and open to hearing it.

      I am not ok with people whom wish to attack someones charter to avoid the merits of debating the actual topic or being patronized by being asked questions I've already answered. Those are what I refer to as liberal Alinsky tactics to avoid discussion of the actual topic by attempting to avoid the inaccuracies of merit or force your ideals on others.

      Fortunately on this subject we'll see what ages well (or not) next week when the 18th passes and the internet shark jumps to it's next insane theory and Trump doesn't cherry pick a out of context piece of Chapter 10 and declare Marshal Law. If by some chance in hell he does, I'll humbly apologize for being wrong and still detest the act of it happening.

      Personally, I am pretty tolerant of just about every except being called a hypocrite. I try very hard and have taken many painful lumps in life to avoid surrendering my own morals to stand by what I (and other times others) believe in. So when someone throws a sideways slur at me like that I don't need the 50 paces!

      Which is probably why when it comes to this whole deep state, election, USSC, state legislature punting and long list of history legal blundering were experiencing I'm at the point of saying DRAW! Too much, too far, for far too long... this new level of low isn't ok with me.

      So as novel as it may seem I am trying to look to the constitution and ask what do "we the people" have left for addressing this regression and looking at the Compact Clause SDF and specifically 32 U.S. Code § 109 and saying to a room full of attorneys... Hey, mayyyybe??? Because it doesn't involve a federal government, legislative bodies, courts or any of the other complete failures we've so far seen.

      I admit, it's the bottom of the barrel... But I'm still within the barrel. What I'm not going to do is look to Trump and hope he fixed all of my problems FOR ME... I'm gonna try to find a way I as a citizen and patriot to help.

    2. People are putting too much stock in this. Note that the 18th is simply a "provide by" date. The DNI could have already issued his report. Nothing says it needs or that it will be released publicly, disclosure of any of its contents is completely by discretion, not mandate.

      More discouragingly the report relies on the pooling of multiple federal agencies reporting upward to the DNI for assembly... How well of you seen ANY agency defend our nation as of late?

      I think Ratcliffe is on the right side, but what is he surrounded by?

      I wouldn't be surprised if the damn thing said conservative groups out of Canada tried to swing the election for Trump.

      I am hopeful that there will be something to it where China or Iran are concerned... But my faith in it's origins is highly tainted.

  4. Again, I will reiterate my comment from last night's thread- the right forum for adjudicating the vote are the state legislatures of AZ, GA, MI, WI, and PA. All of those bodies have had the power, this entire last 6 weeks, to order signature verification on the absentee ballots- their power to do so is contained within their Constitutional power to appoint a competing slate of electors if the governors and Secretaries of State refuse to obey the authentication order.

    It really is that simple- the Republican Party has been in cahoots with the Democrats to get rid of Trump. I am beginning to see it is a corrupt deal from the start- the Republicans won't fight the fraud as long as the Democrats only used the fraud to fix the top line of the ticket, but the Democrats double crossed the Republicans in Georgia and will now take control of the Senate anyway, and will cement it all in 2022 with another round of absentee ballot fraud.

    The Republicans had better wake the fu*k up- they will be decimated in the midterms of 2022 if they don't take a stand now.

    1. Question--not a trick because I don't know the answer: Can the legislatures order signature verification or is it the Secretary of State--who runs elections--who has to order that? All of these states have (I believe) GOP legislatures, but only GA has even a RINO SoS. AZ actually has a Soros SoS.

    2. I agree with all this , I have the same read, and my comment above about Trump's response goes to this. His "strategy" always and everywhere, and especially at this time and place is simply to proclaim the truth of the matter and insist on paying attention to it. Read the tweet. He is not calling his forces to arms, he is not threatening any action or reaction actually, he's simply repeating the truth of the situation. Remember what he is up against all of the spin and distortion and treachery from both sides of the aisle and the disinformation and censorship. He stands firm in proclaiming the truth. I think what Trump has hit upon is that the culture as fomented by our elite is one that no longer recognizes honor as a virtue. I think that is a weakness rather than a strength of our enemies and I think Trump has all along intuited this. Now it is not easy to re-establish honor as a virtue in a culture that has banished it, but you have to start with two people who both hold honor as a virtue and you form an honor group and you build. I think Trump is trying to build an enormous honor group, call us Trump Supporters or call us Americans, but we are those who value honor and seek to live our lives honorably. The left wants to destroy that, we fight them by not giving it up. How big is this honor group is it 75 million or is it 75? I thinks it closer to the former number, everybody may not be aware of what exactly they are responding to or why, but they are attuned to the importance of doing honor to their group. Such as it is.

Letter of the law, the Secretaries of State can refuse the order, Mark, but then the hammer comes down- a competing slate of electors, and then a court case to SCOTUS to determine which slate is the right one. I would predict that SCOTUS in that event would be more likely to give the nod to the legislative slate, but it wouldn't have to- it would be enough to just throw the election into the House.

    5. OK. I was pretty sure that's how it works in WI, but wasn't sure otherwise. A legislature normally passes laws rather than giving orders to another branch of government, but election law seems odd in that respect.

    6. Letter of the law, though, also requires signature authentication in all of these states- all of them. The SoSs and/or the governors have broken the law in all of these states by basically waving through any ballot with any signature of any kind.

  6. The U.S. Constitution grants plenary power to each state's legislature to determine the selection of that state's electors.

    Should the state’s governor , courts or citizens interfere with the selection of the electors, the state’s legislature always retains full power to select the electors in anyway it sees fit.

    In short, no citizen anywhere in the U.S. has a constitutional right to select Presidential electors and therefore cannot be harmed by any other state’s selection process.

    1. mso, I only enabled your comment to tell you that you're an idiot. Plenary power is not granted in this respect to the States to act in any way they see fit. Congress is expressly given the power to act as to the manner of holding elections--if they choose to. Further, clauses of the Constitution are intended to be interpreted in harmony with 1) other portions of the document and 2) in the context of the purpose of the document as a whole.

    4. As a further aside to this asinine comment if what he said is true then the 1965 Civil Rights Act is illegal and the Federal Voting Rights Act is null and void.

      The Democrats implemented their Jim Crow tactics in front of us. And we have leadership (outside of Florida) that is weak willed and fearful. That is why the riots were so widely broadcast. To put fear in.

      So we have to organize and resist. There are more of use than them. We can win this war. The battle may be potentially lost (which I don't believe) but we will win the war.

    5. OK, I was intemperate--and in part wrong.

      I was wrong is claiming that Congress can legislate as to the manner of holding elections and/or choosing electors--Congress can only control the timing.

      What I was taking exception to mostly was mso's claim that that "plenary power"--a term not found in the Constitution--is so absolute that the States can act in any way they see fit such that no other person (or, presumably, State) can be harmed by another State's selection process.

      My view was that mso was throwing up a straw man to support the proposition that the Texas suit had no standing and was even frivolous. But this election controversy is not a question of States following their own laws but precisely of States NOT following their own laws, or even violating their own constitutions. The result is that, by intentionally violating equal protection within their own jurisdictions and depriving their own citizens of free and fair elections, these State have also very obviously harmed the other States (like Texas) by depriving those other States of a fairly weighted Electoral College. This is not a trivial matter.

      I haven't listened to the entirety of the Eastman video, but I'm skeptical that Eastman would be suggesting that Texas had no standing. The video was made before any Texas complaint was filed and so far Eastman is addressing only GA issues within GA. If I'm mistaken, let me know.

I understood them in the context of others’ comments here that the GOP-majority legislatures in the four disputed states could have fixed this mess already, but did not. I think the relevance of Eastman’s remarks, as Giuliani I think highlights during the testimony, is that ANY legislature could take back its power to designated electors if it’s state’s election was found to be either fraudulent or conducted contrary to the procedures stipulated by the legislature.

  7. The problem for Trump all along has been getting verification of the fraud. This is easy to do, though- just examine the absentee ballot signatures- we do that, we will find more than enough fraud to overturn the results in AZ, GA, PA, and WI- I would bet the farm on it for those four states. This is the court relief that Trump has sought and has so far been denied- just an examination to prove the fraud. This is where the legislatures need to act, and they need to do it before early January. Once the fraud is demonstrated, it makes it easier for action to be taken.

    1. A great podcast I have listened to for the last few months is Villa Frei and Barnes. They have talked about this election. Matt Barnes said a comment that would help end the defendant holding all the cards. He said basically if their is shown to be a high probablity of fraud ala Matt Brainerd analysis the it is up to the DEFENDANT to prove there was not fraud. That would turn the whole matter around.

      Of course if we had real leadership in the legislatures they would have forced the audit in the first place.

      What happens if all the fraud we've seen is, in fact, proven, and the executive branch of those states refuses to do anything?

      I think what happened was that the Democrats in those states persuaded the executive branch and the bureaucracy to get rid of the security measures that prevent mail in ballot fraud.

      So signature verification, ensuring that a person couldn't vote once by mail and again in person, ballot harvesting and subsequent alteration of ballots, sending agents to nursing homes and either collecting blank ballots or telling residents how to vote, stealing blank ballots from the printers and filling out the ballots themselves. All those illegal acts were made legal by executive fiat or by the bureaucracy simply ignoring existing laws.

      Then the state supreme courts decided that those changes were not contrary to the state constitution, even though the GOP legislatures didn't pass amendments to existing election law.

      The ballot fraud conservatives have been talking about was converted from illegal acts to non illegal acts prior to election day.

      The GOP majority legislatures refused to take action before the election. The GOP executive branches in AZ and GA refuse to take action after the election.

      What happens if the GOP majorities in those swing states do nothing in the face of proven fraud that is no longer considered to be illegal?

    3. There is ample evidence many state officials are corrupt and that our Supreme Court is helpless to correct the situation the way the law is currently based. In an earlier post, I tried to ‘black box’ the selection of electors to simplify the issue.

      The constitution establishes state legislatures as the determining factors in all national elections. From the outside all, the constitution requires is that when given a slate of candidates, each state legislator will return a slate of electors. That’s it; the only constitutional requirement is that each state legislature directed the elector selection process.

      As stated above, The U.S. constitution does not require states to hold an election to select its electors. The legislature has the sole authority to determine the state’s electors. In fact, early in the nation’s history, many states held elections only for Representatives; the Senators and Presidential electors were selected directly by the legislature.

      During the 2020 election, many states have legalized fraud during the national elections and as we see, there really isn’t much the courts can do about it without themselves overturning the law. The fraud takes the form of ‘mail-in;’ voting where millions of ballots are dropped off at a mailing service along with a list of addresses. There is little or no assurances that those addresses belong to valid, living voters. Nor are there assurances that that address list has not been subjected to additions or subtractions.

      Some states allow ‘ballot harvesting’ where individuals canvass neighborhoods, retirement homes, hospitals, etc. to assist the elderly, sick, homebound or otherwise disabled voters to cast their ballots.

      Then there are voter registration drives where political activists are paid to register new voters. This along with motor/voter laws register huge numbers of people, not all of which who are eligible to vote. Then in the name of convenience, ballot drop boxes are located throughout neighborhoods to make voting easier. They also expanded ballot stuffing to levels never before seen.

      Where we once prevented fraud by requiring each voter to present himself in person, observed by multiple persons, as he was issued a ballot which he then observed as he marked and then submitted the ballot to be counted, we dropped somewhere in the neighborhood of 80 million ballots at the post office for completely unobserved distribution. Nor did we observe who received the ballot, who marked the ballot or who returned the ballot.

      These loosey/goosey processes have facilitated fraud to such an extent that it’s all but impossible to prove. Further, it is up to the states to correct these issues, but because we cannot send a poll watcher with each and every ballot how can we prove anything? Even when we point out these shortcomings, the politicized state election officials refuse to investigate or to take action.

      We need a constitutional amendment to set a baseline for national elections. Do we require an election? Who is eligible to participate? Or perhaps we require the state legislatures to appoint the electors. The latter option places the responsibility upon the legislature; no longer can a fraudulent election process shift the blame off the elected legislature to the voters at large. RINOs can’t hide their votes anymore.

  8. If Trump truly does not have any cards left to play to retain his presidency, he could still easily change the course of history after Jan 20, 2021. He could assemble 75 million people into an economic block that could wreck havoc on the left. With one swift kick, he could call boycotts and destroy Netflix, Disney, Comcast, Newscorp, Google, FaceBook, Twitter, PayPal, NFL, NBA, MLB, etc. It goes without saying that the GOPe pols would never win another election. Why not deploy this power? Because capitalism? No. There is no capitalism anymore only cronyism. What have we got to lose at this point by going after their money?

  9. It’s been VERY revealing which GOP and so called conservatives have been backing Trump, and those calling to accept the fraud, or there was no fraud.

    There will be repercussions. Look what happened to the credulity of Paul Ryan’s, Bill Kristol, and Fox News.

    I don’t think the uniparty, and their so called gop components, see the white hot anger and feeling of betrayal against the corrupt system that stole the election.

  10. West had his seat stolen by the Dem vote "counters." I followed it very closely. He was ahead in one Dem area (Port St. Lucie?) when the poll workers decided to recount a batch of ballots at around 1 a.m. after election day. Then he fell behind and never recovered.

    What followed was weeks of suspicious behavior: not allowing poll watchers to see them counting ballots, failure to explain WHY they "recounted" the ballots in the first place. It was such a mess that the secretary of state finally announced she was going down there to see what was going on. The woman running the show checked herself into the hospital for stress and was not there to answer questions.

    I remember the day when certification would be done at noon. The Dem "vote counters" had agreed to recount the original tranche of ballots that had put West behind. This had been delayed by "machine malfunctions" the day prior, and in the end they recounted a different tranche instead of the one they'd agreed to recount. Then, oh, well, noon came and they certified the "votes." The press reported none of this, especially the national press. I searched around for info from local media and West's campaign to piece all this together. It was horrifying.

    In 2012, Romney's poll watchers were thrown out in Philly and they had to go to court. There were huge ballot runs I believe literally 100% for Obama. This year's steal is same old, same old but seemingly on a larger scale. Dems use minority vote "counters" to do their dirty work so that the media won't cover the kicking out of poll watchers and all the rest of the crooked goings-on. We all know that if Republican poll workers were kicking out minority poll watchers and all the rest it would be front-page news for days!

  13. Media, Court Systems, and State Governments in some areas is inoperative as a relief valve due to political biases and corruption.

    I expect a lot of biased actors are going to get sidelined by angry Trump Voters. The uniparty GOP will be astonished by the electoral revenge of Trump Voters. The GOP is not going back to business as usual.

    And I’m sure more and more evidence of voter fraud will continue to come out every day, no matter what the msm and Internet giants do. And the more they censor, the greater their loss of credibility, and the coming backlash.

If this report confirms the existence of foreign interference that was capable of altering the outcome of the election, it gives President Trump full justification to declare the election null and void and dispatch military troops to seize all ballots and hold a new count under military authority.

      It has some merit and some power over foreign entities and domestic entities acting on behalf of foreign entities, but nothing like is being suggested.

      You are welcome of course to read it and come back to correct me with the document paragraph by paragraph if you wish. I'm sure I missed a few things when I read it and then reread several parts of it from dozing off.

  18. Just read Dick Morris's take that the Democrat packing threats buffaloed SCOTUS into bowing out. Maybe correct take or maybe not, but if so then the court is made up of 9 of the thickest, most historically ignorant, village idiots to ever come down the pike. The Dem's are going to pack it and pack it hard. The election stealing will refine, though still be "in your face", because humiliation is an important aspect of domination, and move to include the entire ballot. D.C. will be elevated to statehood. The Dem's will never allow honest, accountable, gov't again.
