UPDATED AND CORRECTED: SCOTUS: What Constitution?

The full text of the order is below. We've all heard that "No Man Is An Island." It seems that the SCOTUS is of the view that each State in the so-called Union IS an island. That each State is now free to define its own version of a republican form of government and it's nobody else's business. This, of course, opens the way for coalitions of States to form and engage in systematic jiggering of elections--the SCOTUS has washed its hands of this Constitution business.

I think it's safe to say that the three Trump justices will live to rue this day and this work. Sadly, so may all of us. The consequences of this will not be long in coming.


TEXAS V. PENNSYLVANIA, ET AL.


 The State of Texas’s motion for leave to file a bill of complaint is denied for lack of standing under Article III of the Constitution. Texas has not demonstrated a judicially cognizable interest in the manner in which another State conducts its elections. All other pending motions are dismissed as moot.


 Statement of Justice Alito, with whom Justice Thomas joins: In my view, we do not have discretion to deny the filing of a bill of  complaint in a case that falls within our original jurisdiction. See Arizona v. California, 589 U. S. ___(Feb. 24, 2020) (Thomas, J., dissenting). I would therefore grant the motion to file the bill of complaint but would not grant other relief, and I express no view on any other issue.


No doubt there will be plenty of commentary and we'll try to keep up with it.

In almost every Michigan precinct, Biden had exact 50-55% higher absentee totals than TrumpIn 5 seconds, Biden’s total votes in Michigan went up 140,000 votes. In 9 problem Michigan Counties, the absentee votes between Trump and Biden are so similar that the study’s author says they are clear indications of vote machine manipulation.

UPDATE 2: The Michigan AG is blocking the results of the forensic audit of the Antrim County Dominion machines. What does that tell you. SCOTUS coulda heard evidence on that. Ho hum.

UPDATE 3: The SCOTUS as a constitutional institution--and therefore the judiciary as a co-equal branch of government--has delegitimized itself. I don't think that's retrievable. From here on out, US politics will be changed and the rule of law will be sidelined except for a bit of lip service. It's power that will be the currency of the land.

CORRECTION: aNanyMouse states that Rudy Giuliani explained the action of the SCOTUS. Andy S.'s explanation (comment below) is mistaken, and I think a close reading shows that. What the SCOTUS did was claim that in their discretion they were denying leave for Texas to file the complaint. Alito and Thomas stated that the SCOTUS has no such discretion in cases of original jurisdiction and should have granted leave for Texas to file the complaint. Obviously that would have opened the door for submission of evidence, and as to would have been the result of that Alito and Thomas could not speak.

I apologize to readers for jumping to the wrong conclusion.

  6. This cloak and dagger approach by SCOTUS just reeks of chickenshit, but I am a layperson. So is their reasoning bow that the legislatures of those states have to step up to fix it? Because the SCs of these states have already gone around their legislative bodies.

    What a complete cluster this is.

    2. A "civil war" isn't needed to correct this and it is the end of the United States. Texas, followed by close to half the other states will very likely just secede and walk out without a shot being fired.

      That was the point. Does anyone have naval background to know whether this *is* normal deployments or is it unusual? Combined with the unusual military flights, it raises the question of whether we are gearing up for open hostilities.

      I would be concerned about "invasion forces or shelling" in the SF Bay Area as it would negatively impact my property values.

  13. the forensic audit was the result of a lawsuit by a private michigan citizen mr bailey done by his attorneys team. the attorney was on greg kelley last night saying the audit shiwed the machine flipped vite to biden. so not sure how the soc is 'blocking' the results?

    1. Once again this was a procedural decision, not a decision on the merits. There has still not been a case raising these issues decided on the merits.

    2. Several cases are still alive in various courts in various contested states.

    3. It is not too late for the various state legislatures to act.

    And if worse comes to worse, God help Joe Biden. He will need it.

      As for your point, I agree, but in a somewhat different direction as well also in agreement with you. What I mean ...

      I agree that America is large and diverse enough that a split is conceivable. This morning we learn that Oracle is the latest in a series of corporate giants that has moved its HQ to Texas. Texas is, in fact, a viable nation and would likely draw to it additional areas of the country as a gravitational center. I don't envision military force to stop this--it would only take a bit of nerve.

      My further point, however, is that now that the Supreme Court has revealed for all to see that the principle behind the Constitution is no longer the rule of law but raw power, there are men hungry for power who will know how to seize what they will rightly see--in the circumstances--as a grand opportunity. All it will take is a whiff of grapeshot. God help the corrupt political establishment.

    5. Thinking through secession is a big job. I'm not remotely there yet nor am I, in all likelihood, up to the task. Many unknowns, including unknown unknowns. Not for or against just need to give it (a lot of) thought.

      In the shorter term, I think the gleeful Dems who have celebrated Biden's several 'victories' (including yesterday's) are in for a rude awakening.

      1. Biden is senile and cognitively diminished (below the point where he can manage the office) and will have to go. Sooner than later.

      2. The criminal investigations of Biden's family members will taint and then destroy his reputation and thus his legitimacy. This will accelerate his departure.

      3. Harris is way too far Left to successfully govern this country. She will neither command nor retain the respect of a large majority of Americans and her presidency, if and when it eventuates, will be, itself, viewed as illegitimate and then ridiculed and ultimately destroyed.

      4. The (apparent) unwillingness of the Supreme Court to address compelling issues of election illegality will greatly undermine both respect for it and respect for the rule of law, leading to perhaps predictable results.

      5. A large number of Americans, probably a majority, doubt the legitimacy of the election and will conclude that efforts to govern by an illegitimate executive are themselves illegitimate, again with predictable consequences.

      6. Given the failure (thus far) to address election irregularities in the November election, neither side will accept the results of the Georgia election in January 2021, further driving the country apart.

      7. Congress will have to deal with the issues of election legality raised in 2020 but reaching a consensus will be impossible, thus driving the country even further apart.

      8. By promoting propaganda and failing to investigate the truth the Main Stream Media will exacerbate (and not ameliorate) distrust and growing hatred between the sides.

      9. The unravelling and destruction of the two historic political parties will accelerate. The Texas case has already made apparent the division between the Trump party and the GOPe and Biden's presidency will expose yawning chasms between snowflakes/suburban housewives and the Leftist agenda. The corrupt politics of Wall Street and bought and paid for politicians of the Uniparty will be further exposed for both sides to see.

      10. The odds on near term civil unrest and civil violence have to have greatly increased.

      Yes. God help us all.

      Thanks to Texas & Trumps amazing superpower to trigger people & institutions into revealing who they really are, we now have a good idea of which states are on Team America and which are on Team China, along with a number of state & federal congressmen, etc.

      Second I am uncertain why you thought taking all of that gear into a deep body of water was a good idea.

      Third I am sorry you can not afford to replace any of it and now have to go without.

      Going forward we should all learn from Dave's experience by all practicing our heavy load paddling techniques. I too have made this same mistake and have lost everything. Accidents do happen but they can be a blessing in disguise.

  21. We need to send a message that will really draw a line in the sand. Saying bad things about John Roberts et al. will no longer suffice. Looking at the Republicans in the House and Senate, I am NOT certain we have a critical mass. However, there just might be a chance at the state level. Unfortunately, it is probably too late for this election cycle, but let's look ahead to 2022 (assuming George Soros, Bill Gates, Mark Zuckerburg allow us to have an election). Texas should announce 5 minutes BEFORE the polls close that all Republican candidates have won 20,000,000 to 0. Assure everyone that the election was carefully monitored and that there was no fraud. All lawsuits, including at the level of SCOTUS, are dismissed by the State of Texas as invalid based on the precedents established in 2020 and, in any case, SCOTUS cannot enforce any of its decisions. This was an 1860 election and we now need to re-establish the authority of the States versus the Federal government. United States? Not so much. Neil in SD

I have lived here for 20 years and the rate of decline is visible on a day-to-day basis. Raised in the midwest and lived in Houston for 18 years.     But, incidentally, your colloquy does raise a good question.

    If many places in the United States of America are no longer congenial places to live, where to go?

    The Anglo-Saxon sphere seems increasingly consumed in guilt and progressive socialism. So does that rule Canada, Australia and New Zealand out?

    There are numerous expat American enclaves in Central and South America, some even in places with conservative governments. But all must have challenges w/respect to language, customs, jobs, security, etc.

    W/in the United States, Texas and Florida are certainly attracting business(es), but how much longer will they be Red States? Cf. the close calls w Beto O'Rourke and Andrew Gillum. What about the Red States in fly-over country? Why not? Do you think one can escape the destruction of the country and our value system in South Dakota...or Wyoming or Alaska?

    Or does one stay put and fight the good fight? What did our forefathers do?
