ReplyDeleteJacobson at Legal Insurrection has an insightful piece on the effect of Barr’s remark about “spying” and now Durham’s handling of what is now publicly acknowledged to be a criminal prosecution. Jacobson advises the unknowing that Durham is someone to be feared and these guys do know it. Baker has already toppled, if you can believe OAN, and everyone seems to…. Who will be next?
Lifson at AmThinker ties McCabe's action here into the likelihood of his indictment. I have to believe that McCabe is not entirely compos mentis--I've been saying that he's a nut, and this seems conclusive.
DeleteRejecting the plea, even if it's a tough deal, is a bad idea because he's gonna go down. And he'll get no mercy when that happens, after spurning the plea offer.

IMHO there are a few key people who should NOT be offered deals and face prosecution and judgement. McCabe, Weissman, Strzok, Brennan, Clapper, (Comey?) "But I'll cooperate! -- Sorry that time has passed." (or notify their attorneys of the list and that you will only take the first 3 applicants...)
DeleteAnother thing I would wish for in the cases where testimony/cooperation results in their escaping justice: Sentenced to public televised admission of what they perpetrated, their participation, and their guilt.

I think what could happen with those key people is that the "deals" that they're offered will amount to--plead guilty to sufficient counts that will cover the full extent of your criminality, cooperate fully and completely, and we will offer some minimal reduction in sentence. But there will be jail time. Take it or leave it. If you leave it, we will do all in our power to hammer you.
DeleteMy fear has been, that McCabe etc. would take the reasonable gamble, that Beltway area types will hang all juries in all trials in that venue.

If Prosobiec is right about Baker, I'll bet that Baker just doesn't want the hassle of trial after trial, even
if he can count on one hung jury after another.
Maybe Baker isn't such a fanatic as Comey, as to be delighted to become known, for spending the rest of his life in court, as a "martyr in the fight vs. Trump's White Patriarchy".
Comey is nuts, only in the sense that his fellow Awoken SJWs are nuts.
If Barr/Durham works out according to plan, Baker WILL be going through trial after trial--as a witness for the prosecution. Nobody will care if he regards that as a "hassle."

ReplyDeleteI'm presuming that Baker flipped, to avoid the hassle of being the suspect in multiple trials. The hassle of being only a witness is chump change, as long as the DoJ can protect him & his family from unprecedented SJW wrath (funded by e.g. Soros).
I'm guessing that McCabe etc. will prefer the hassle of being cross-examined in front of many (eventually hung) juries, over being tarred as a Traitor to Awokenness.
Baker would become the greatest Bane in the history of the U.S. Left, and McCabe etc. would be the ultimate Martyrs, in this scenario.
I understood that, but find it quite unconvincing. I think McCabe's gamble is reckless and a bit crazy. I don't believe--for reasons I've gone through--that McCabe will be a sympathetic defendant at all.

I think any of these guys who wants to go to trial hoping for an acquittal or a hung jury is adopting a very high risk strategy.

DeleteI don't mean to suggest that McCabe couldn't plead. But in all likelihood he is facing serious time and any deal would involve serious 'co-operation'. One can imagine the implications.

He's got some tough choices. I just don't think going to trial and hoping for a hung jury is one of them.
IMO, he'd better make up his mind fast, and if he hasn't been offered a plea deal he should be actively seeking one. If James Baker has already flipped, as reported, and possibly McCabe's own counsel, Lisa Page, he's in a very risky position.

DeleteAs far as any romantic notions McCabe might have (or have had) nothing focuses the mind like the prospect of decade(s) of jail time for undeniable criminal conduct. I would expect McCabe ultimately to co-operate although, as Mark suggests, his bargaining position may not be very strong.

Law enforcement defendants are a breed apart. LE defendants accused--with documentary evidence--of altering or inventing evidence to send people to jail will not receive lenient treatment. Conspiracy to violate civil rights, etc.
