UPDATED: BREAKING: Ruth Bader Ginsburg Is Dead

What can I say? This really stirs the waters for the election.

Overall, I think this helps Trump. It's puts pressure on Biden--or whoever tells Biden what to say--to name his candidates for SCOTUS. Trump has already done so.

The real question is--does Trump have a charismatic candidate for the SCOTUS who would be up for a confirmation fight at this juncture? Even without a hearing or vote at this point, it would focus the entire campaign. We've seen what that has meant in the past with Kavanaugh--big plus for Trump.

I guess lockdown is over for the duration of the Ruth Bader Ginsburg funeral orgies.

It will be interesting to see how extravagant, prolonged, and shameless they will be:

John McCain-level?

John Lewis-level?

Or thermonuclear George Floyd-level?

  2. Senators Collins and Murkowski have already announced that they will not advance a justice until after the election. Can you imagine the cluster that will happen if there is a 4-4 split over the national election? With all the legal challenges the Dems have promised, it is virtually guaranteed the SC will be involved in those suits at some point.

    I know this just means the circuit court ruling stands, but then we will have 9 versions of rulings potentially coming out. 2020 is truly a crazy year.

  3. Headlining on a couple sites: Murkowski will not vote on Ginsberg replacement until after election. Add in Mittens and Collins, McConnell better have some leverage if he thinks he will get to a vote in the senate.

    1. Color me optimistic. I don't think a vote is the real point. Recall that Trump was a first time candidate last time, with the Scalia vacancy. It's said that the threat of a Hillary justice was a significant help to Trump. It should be even more so now.

If Trump offers up a nominee, and I believe he will, that will also allow him to remind voters how the democrats in the senate - can you say Kamala Harris - treated his second nominee Kavanaugh. It seems to be a plus for Trump and it will likely put Biden on defense and forced to name his potential SCOTUS nominees.

    4. The Party is more determined/brazen than ever. Michigan and Pennsylvania are almost certainly lost. Odds go up daily that the election will end up in the SCOTUS.

    President Trump has said he will name his nominee shortly and McConnell has issued his statement that he will have a vote on whomever PDJT nominates.

    She should have retired a long time ago. As for her deathbed wish, conveniently dictated to her relative for conveyance to NPR, pfffffft.

    In addition to Benedict Romney, Collins, and Murkowsky, apparently Grassley (at some point) said he wouldn’t vote for a nominee. We’ll see.

    These so-called Republicans remind me of that tired saying “with friends like that, we don’t need enemies” or Pogo “we have met the enemy and it is us”…

    Meanwhile Dems vote for anyone with a (D) after their name, and don’t even care if they’re breathing.

Might it not be more advantageous to Trump to run on the promise of nominating a judicial conservative if he wins than to run simultaneously with the nomination of a judicial conservative who will be subject to a Kavanaugh-like onslaught of opposition which Trump may find it difficult to control, let alone prevail on? How, for example, would a loss on a Senate vote on say, October 31, affect his own prospects a few days later?

    Or maybe the one after the next one, right? Because if Trump is re-elected...

    And since RBG's last wish — which of course supercedes all administrative procedure and law — was that she only be replaced after the next president is "installed"... Safe to assume she didn't mean the current POTUS. M'kay, so if Beijing Biden doesn't win, we'll just have to wait until 2024 at the earliest for a replacement. Maybe 2028.

  10. Interestingly, there are Lefties out there outspokenly cursing Ginsburg for her arrogance in refusing to step down and let Obama name a replacement for her. Apparently she had visions of herself swearing in President Hillary, or some such thing.

    “instruction” (Obama’s term) to her granddaughter Clara several weeks before she died. There goes the "deathbed wish" meme.

  13. If there is a delay of either nominating or voting until after Nov. 3 then nothing will happen until after Jan. 20. Any action after election day will elicit a tsunami of lawsuits declaring the entire process illegitimate due to the election being contested/unresolved, and there will be Dist. Judges standing in line to issue injunctions. That being the case, when the election lands in the SCOTUS the outcome will be Harris/Biden 5-3.
