Is Chris Wray Cruising For A Bruising?

Before turning to John Solomon's latest major article, let's briefly consider FBI Director Chris Wray's track record since taking over at the FBI.

- He actively collaborated with Rod Rosenstein in delaying and thwarting GOP House investigators who were attempting to get to the bottom of the Russia Hoax.
- He continues to delay DoJ investigative efforts by holding up declassification of key documents.
- He has publicly contradicted AG Barr, saying that he disagrees with Barr's characterization of FBI actions during the 2016 campaign--and continuing, it now appears, virtually up to the present--as "spying."
- Most recently, Wray responded to Senator Ted Cruz's call for a RICO investigation of Antifa by stating that the FBI views antifa as more of an ideology and noted that the FBI does not investigate ideology. He went on to suggest that the FBI was investigating "anarchist extremists" more or less as individuals.

Who can take a guy like this seriously? The FBI didn't engage in active "spying" on a political campaign and candidate? Really? Antifa activities are not coordinated? Really? Chris Wray is a waste of space.

Is it any wonder that one of Wray's remaining allies--Dan Coats--is being removed as DNI? Who thinks that when President Trump--only days after Wray's absurd statements about Antifa--stated that "[c]onsideration is being given to declaring ANTIFA ... a major Organization of Terror", Trump had not already discussed the matter with Bill Barr? Count on it: Bill Barr is NOT on the same page with Chris Wray. Discount Barr's public "nice talk," just as you should discount his public "my friend Bob" statements. I have no doubt at all that Barr has taken the measure of Wray.

In the wake of Coats' ouster from DNI, Paul Sperry tweeted:

"Christopher Wray Is Becoming A Very Big Problem"

I've been on FBI Director Chris Wray's case for some time now. You can review past posts here. The quote in the title, "Christopher Wray Is Becoming A Very Big Problem," is taken from an interview with Joe DiGenova on Monday, May 13, 2019. DiGenova touched on a number of Chris Wray related problems:

Wray was behind the illegal classification of the Kathleen Kavalec memo;
The decision requiring Wray to declassify that memo was taken by DoJ;
Wray's Congressional testimony in which he disagreed with AG Bill Barr's use of the word "spying", or at least distanced himself, was "badly received throughout the Trump administration;
Wray was recommended to Trump by Chris Christie.

I have in the past pointed out Wray's close association with Andrew Weissmann in the notorious Enron case (Weissmann's theory of obstruction was rejected by the SCOTUS 9-0, but only after Arthur Andersen was destroyed and ten thousand people lost their jobs). DiGenova adds to that and sketches out Wray's Deep State connections by relating that Wray is close friends with Robert Mueller and James Comey, terming Wray "an acolyte [altar boy] of Comey," adding that Wray "worshipped" Comey.

Wray can't be gone soon enough for me.

Jim Jordan Goes After Chris Wray

Congressman Jim Jordan appeared on Fox and Friends this morning. Probably the most notable aspect of the exchanges was the ferocity with which Jordan attacked waste of space FBI Director Chris Wray. He ridiculed Wray repeatedly, focusing on Wray's pathetic attempts to soft peddle FISA abuse, but also on the Flynn case. Here are some excerpts--mostly out of context--that TGP ran that will give a flavor:

Rep. Jim Jordan: “And now we learn that they set up the General Mike Flynn just days into the administration! What I want to know is why didn’t Bob Mueller tell us this? Remember we were told… this is the greatest guy who ever came to Washington. This is the greatest thing since sliced bread. He’s the most honest guy since George Washington. Why didn’t he tell us this and more importantly, where’s Christopher Wray? Why didn’t we learn any of this from him? Thank goodness for Sidney Powell or Bill Barr or we would have never got this information… Again why didn’t we hear this from Chris Wray? ... Again if they can do this to a three star general, if they can do this to the President of the United States, imagine what they can do to you and me?

Here are a few more excerpts that I liked. Steve set up the context for the Flynn case admirably:

Steve: It now looks ... somebody at the FBI, somebody at the Department of Justice, was out to get Flynn, essentially entrap him, ... so that they could get rid of him, embarrass the Trump administration--a *gut punch* just at the time of the inauguration.

Exactly. The Flynn setup wasn't just about Flynn. It was intended at a minimum to cripple the Trump administration, but the more likely maximum intent was to create a public firestorm to force Trump to resign or be impeached right at the start.

Jordan returns to the main point:

Jordan: Christopher Wray needs to tell us what he's been up to these last two and a half years he's been Director of the FBI.
Jordan: But the people at the top [of the FBI], remember what Bill Barr said a year ago? He said there was 'a failure of leadership at the upper echelon of the FBI'. That may be the greatest understatement ever. Comey, McCabe, Baker, Strzok, Page ...
Steve: Explain how this [the Durham investigation, the Jensen review, etc., all put in place by Bill Barr] could be part of a bigger picture ...
Jordan: Well said. ... The big question: What 'they' did before him [Barr].
Jordan: All these things happening ... The only thing we had wrong is, it was worse than we thought.

I think Jordan gets the scope of the Durham investigation: Everything that happened before Barr took over as AG. That means the Mueller Witchhunt, and the Mueller Witchhunt was no more than the prelude to impeachment. While it fizzled in that regard, for the most part, some of the same important players were involved in the impeachment hoax as were involved in the Russia hoax and the Flynn setup--notably Mary McCord.

I think this is why Durham's investigation keeps extending. He's making real progress and increasingly believes he can get to the end of that road: Mueller and fake impeachment.

A mark of disgrace in all this goes to sundance at CTH, who chose to run a lengthy screed attacking Bill Barr. Sundance makes the moronic claim that the Jensen review of the Flynn case occurred only because the FISC demanded that a review be done of all cases connected to the Carter Page FISA. The Jensen review was totally unconnected to the Carter Page FISA. The US routinely conducts electronic surveillance of Russian establishments. The Flynn case had no need to rely on the Carter Page FISA--the intercept of Flynn's conversation with Kislyak was pure routine.

Chris Wray: Deep State Tool

Any notion that the Deep State would drop the Russia Hoax, leaving the fomenting of anti-Russian paranoia and hysteria to such disreputable stalkers of the President as Adam Schiff, were laid to rest by Chris Wray. As reported by the NYT, Wray spoke Friday to a predictably Deep State friendly audience at the Council on Foreign Relations in DC, seeking to stoke hysteria in anticipation of the 2020 election:

WASHINGTON — The F.B.I. director warned anew on Friday about Russia’s continued meddling in American elections, calling it a “significant counterintelligence threat.” The bureau has shifted additional agents and analysts to shore up defenses against foreign interference, according to a senior F.B.I. official.
The Trump administration has come to see that Russia’s influence operations have morphed into a persistent threat. The F.B.I., the intelligence agencies and the Department of Homeland Security have made permanent the task forces they created to confront 2018 midterm election interference, senior American national security officials said.
“We recognize that our adversaries are going to keep adapting and upping their game,” Christopher A. Wray, the F.B.I. director, said Friday in a speech in Washington, citing the presence of Russian intelligence officers in the United States and the Kremlin’s record of malign influence operations.
“So we are very much viewing 2018 as just kind of a dress rehearsal for the big show in 2020,” he said.
...
But outside of meetings with Mr. Trump, intelligence officials have continued to raise alarms. Officials including both Mr. Wray and Dan Coats, the director of national intelligence, have said Russia has aimed its influence campaigns at undermining faith in American democracy.
“What has pretty much continued unabated is the use of social media, fake news, propaganda, false personas, etc. to spin us up, pit us against each other, to sow divisiveness and discord, to undermine America’s faith in democracy,” Mr. Wray said on Friday. “That is not just an election-cycle threat. It is pretty much a 365-day-a-year threat.”

Wray is either a fool--if he believes this nonsense about the social media threat posed by Russian based "troll farms"--or a knave--presuming that he actually knows better. More likely he's both. A fool for presuming to possess actual credibility, a knave for undertaking to fool the American people.

Bye, Bye, Boente

Yesterday we learned that Dana Boente--long time Deep State operative in the DoJ, and currently General Counsel at Chris Wray's FBI--was apparently given the choice of being fired or of resigning. He resigned. The General Counsel is essentially the FBI Director's personal lawyer for official business, so it can be assumed that the two work hand in glove together. Nevertheless, reports had it that

"the decision to dismiss [Boente]came from high levels of the Justice Dept. rather than directly from FBI Director Wray."

I think it's safe to say that this was AG Bill Barr's decision, and that Barr saw no reason to consider anything Wray had to say on the matter. If Barr took that attitude toward firing Wray's right hand man for all things legal pertaining to the FBI, it's hard to see how Wray himself is not on thin ice--despite Barr's typical supportive statements. That's just Barr's style--everything's fine until suddenly they're not fine.

Monica Showalter has a nice summary of the firing and its possible implications for Wray: Bell tolling for FBI Director Christopher Wray? As a reminder of who Boente is, she quotes sundance:

Dana Boente is enmeshed in all of it: the Wolfe case and cover-up, the Assange case and cover-up, and the hiding of documents in the Flynn case and cover-up.  Boente’s role as a manipulative fixer to protect the ongoing corrupt action of the Mueller probe was exactly why FBI Director Chris Wray hired him.

Boente also signed off on one of the Carter Page FISA renewals, so that could be another thing hanging over his head.

Sundance, of course, has to aim one of his trademark dumb-ass asides at Barr, but I think Showalter gets it exactly right:

Attorney General Bill Barr is a tough player. And the Trump team has already demonstrated that 'you're fired' is a thing.

Trump could have cleaned house before Barr took over. He didn't do it, presumably for good reasons. Barr is doing his housecleaning at his own pace and in his own style. His style is apolitical--actions speak louder than words. Barr's views are well known. He has no need to convince anyone that he's in charge. When the time is right he pulls the trigger, and he doesn't back down. For example, Barr apparently thought Tim Shea was the right guy for the USAO in DC, but when Shea screwed up he was quickly removed, without fanfare. Wray may be about to find out all about Barr's approach to managing.

Chris Wray Is On Thin Ice At FBI

It's pretty clear that FBI Director Chris Wray got slapped down by AG Bill Barr when the FBI tried to hide the Kathleen Kavalec material regarding her interview with Chris Steele. Judicial Watch has been trying to obtain disgraced former FBI Deputy Director Andrew McCabe's text messages. Jucidial Watch has been met with what Devin Nunes likes to call "the usual stonewall" from the FBI. Late last night Trump retweeted Judicial Watch's Tom Fitton's slam at Wray and the FBI:

Donald J. Trump Retweeted

Tom Fitton‏

@TomFitton
BIG: @realDonaldTrump authorizes AG Barr to declassify #Spygate docs from all agencies!  Coming up!

FBI hiding transcripts that could exonerate @RealDonaldTrump and implicate Comey-Obama FBI? Plus @JudicialWatch catches FBI in yet another Clinton email cover-up.  All this and more on the Coup Cabal…
FBI refuses to search text messages under FOIA. Director Wray needs to step up and stop this stonewalling that protects corrupt former FBI officials Comey. McCabe, Page, Strzok....
FBI still hiding Andrew McCabe's text messages.
https://twitter.com/TomFitton/status/941008606387998720 …

It's clear from the president's declass order that Trump and Barr are totally on the same page. It's also clear that Trump has no respect for Wray and his Deep State coverup attempts. The nice talk about Wray from Barr? It means nothing. Wray is on very thin ice.

Briefly Noted: Final Three FISAs Obtained "Illegally", Papadopoulos Framed By FBI

Joe DiGenova is stating publicly that the conclusion that IG Horowitz has come to--which DiGenova is stating because of the Kavalec revelations--is that the final three FISAs were obtained "illegally." The only thing left to determine is whether the first, original application, was obtained illegally.

DiGenova states that the FBI hid the Kavalec material from Horowitz and that that is the reason Horowitz has thus far been unable to come to a conclusion regarding the original FISA application. Now, the Kavalec material, in all its damning detail, is "out there."

Jim Comey, Rod Rosenstein, Andy McCabe--and many more--call your lawyers' offices!

Watch the video here.

Toensing and DiGenova also confirm what we've been maintaining all along, that the business of Papadopoulos being braced at Dulles, searched for $10,000, was a an FBI sting. Simply put, the FBI doesn't routinely do airport searches for customs violations. Toensing adds:

“This is what happens when you work for Donald Trump.”

Hmmmm.

Toensing and DiGenova have been busy making the rounds. They were also interviewed by Sebastian Gorka:

I love DiGenova's summary opinion of FBI Director Chris Wray. Toensing straightforwardly states that Wray is corrupt (with a specific example) and Joe adds that all Wray cares about is his next job. In fact, here's a transcript of that portion:

Sebastian Gorka: Barr's gonna get to the bottom of this stuff, but there's an institutional problem here [at the FBI].
Joe DiGenova: There has to be accountability for all this, and the only way you have that is with a gigantic investigation into how it all happened, which means Grand Juries, indictments if necessary, ...
Gorka: But that doesn't change culture.
DiGenova: Then you have to have a public accounting, and you have to have leaders. We have one now with Barr. The FBI however is rudderless. Chris Wray is a disaster. He's an empty suit. Not only that, he's disingenuous. He has never given the big speech that you have to give when you come into an organization like that: "We're gonna fix this, we made some bad mistakes." He has never said that. How can you lead an institution back to credibility when you don't address the problem frontally?
Victoria Toensing: We took him evidence of corruption during the Bush administration when he was the Assistant Attorney General for Criminal, over all the US Attorneys, when we took him specific information and evidence about a US Attorney and he refused to do anything.
DiGenova: He's a very bad person for the job, he's the wrong person, because the only thing that Chris Wray has ever cared about is his next job.
Gorka: That's DC, that's DC. The tyranny of mediocrity and those without a spine shall be promoted. When have we seen that before?

Gorka also points out that Barr, in his testimony, has not only fingered the DoJ and FBI as needing to be cleaned up, he has also stated that "the Intelligence Community troubles him."

Interesting Discussion On Chris Wray's Future

This afternoon there was an interesting discussion that I've excerpted below from Shipwreckedcrew's twitter thread. It features mostly SWC, but additional comments are from Andy McCarthy and two former Bureau guys: James Gagliano and Jim Casey. So, you have a bit of a balanced perspective--two DoJ guys and two Bureau guys. We all know McCarthy and SWC, but here's some background on Gagliano and Casey. I think the background is important in assessing their views as expressed here.

Joe diGenova On Biden Inc., Chris Wray, And Bill Barr

It should come as no surprise that in his latest appearance on WMAL Joe diGenova goes after Chris Wray in no uncertain terms--again. He absolutely detests Wray and the thing about that is, diGenova is perfectly placed--has been for decades--to have the lowdown on all the people we're watching in the Swamp.

I've transcribed just a few minutes of Joe's appearance. It's the part, beginning around 10:30, where he responds to a question about the Biden Inc. scandal. He first excoriates Wray, in his usual terms, but then Mary Walter asks the question so many people ask: Hey, what about Bill Barr? I addressed that just yesterday, but ...

JOE diGENOVA: [Describes apparent lack of FBI investigation into Biden family.] The evidence of illegal activity--whether it's FARA, Foreign Agents Registration Act, bribery, extortion, conspiracy by the vice president while he was flying around with his son on planes to foreign countries where his son then got business--la di da, how did that happen? This is ridiculous. And the fact that the FBI under Christopher Wray has done absolutely nothing--that we know of. There could be some bizarre, strange, ongoing, detailed, fabulous federal criminal investigation--my guess is, that ain't so--and so we are left with an empty bucket of nothing from the FBI and the Department of Justice.

I hope that Bill Barr, as soon as the election is over, will explain WHAT THE HELL IS GOING ON with the Biden family. This is unacceptable. Either have one set of laws for everybody, or you don't. And right now, we have two sets of rules--one for Democrats, one for Republicans. And if anyone thinks that isn't true, they're an idiot.

MARY WALTER: Do you think the Attorney General will look into this and do something about this--even after the election?

JOE: I do. I do. And the reason for that is very simple. I have known Bill Barr for more than thirty years. He is a CONSUMMATE lawyer. He is also someone who believes very deeply in the integrity of the Department of Justice and he knows that it was compromised during the Obama administration, where that beautiful building was turned into a partisan political activity center, led by Andrew Weissmann--perhaps the worst federal prosecutor in the history of the department. And now he [Barr] has to inherit this mess. He took over--he, Bill Barr, took over with very little time to right the ship that's there. He's working on it. He's trying to do it. And he's being fought at every step of the way by career DoJ attorneys who are Democrats--95% of all the contributions going to the FEC from the DoJ went to Hillary Rodham Clinton.

I'll simply add this. If Donald Trump has been unable to clean up his own White House--although since the fake impeachment he has made some strides--why should anyone think that the task of cleaning up DoJ, with all the entrenched attorneys protected under Civil Service, will be any easier for Barr?

How many Chiefs of Staff has Trump gone through, and how many of them have turned out to have been sabotaging him? The military is still largely defying him. How long did it take him to maneuver John Ratcliffe into a position of influence? And yet Gina Haspel is still in place to thwart investigations.

Hopefully, the election will be a real watershed. Trump's move on Civil Service could be a harbinger of things to come, and it may well also empower AG Barr.

Joe diGenova: The Declass Dam Breaks On Wednesday

In his regular appearance on WMAL radio this morning, former DC USA Joe diGenova said that the dam on declass--maintained by outgoing DNI Coats and, unfortunately, current Director FBI Chris Wray is about to break. diGenova says he's told that AG Bill Barr will be releasing declassed documents starting Wednesday--publicly:

diGenova: The reason Barr was given declassification authority was because Coats was in the way--as was Chris Wray, the FBI Director. They were fighting tooth and nail--phony coverups, allegedly to protect sources and methods, when Chris Wray was simply trying to protect the FBI from just HUGELY embarrassing details that are gonna come out now. By the way, the declassification process will start this week. There are going to be documents released, I think by Wednesday. The Attorney General, as I understand it, is in the process of getting those ready to come out. There are gonna be some of the Devin Nunes documents that he requested and then a series of other releases will come after that, because Durham is progressing VERY, very quickly in his criminal investigation. This is not a "review," quote unquote, of what went on. This is a criminal investigation of senior DoJ and FBI officials from the Obama administration and Intelligence Community people--including John Brennan. This is a Federal Grand Jury. This is not a review, this is not an IG audit, this is not some Congressional Research Service look at history. This is a criminal investigation of a bunch of people who tried to seditiously overthrow the President of the United States. So, the stuff is gonna start coming out this week.

One thing I'd like to point out--diGenova, a very highly regarded and experienced lawyer and former US Attorney for DC, used the word "seditiously." Coming from someone of his background I would expect that to be a direct reference to the Smith Act. As I've said before, in the United States prosecutions under the Smith Act require incitement to physical violence--check out the link to Wikipedia and read up on the case law.

On the other hand, it's possible that he was using, for emphasis, the general meaning of the word. Here's how Wikipedia defines it:

NYT News Flash For Chris Wray: Antifa Is A Thing

Waste of space FBI Director for the nonce, Chris Wray, made news recently by announcing that Antifa isn't an organization. Wray was even quoted to that effect by Joe Biden in one of his rare appearances--contradicting AG Bill Barr.

Mirabile dictu, today in the NYT (h/t Steve Sailer) Farah Stockman--a member of the NYT editorial board, no less--goes all counter narratival. Stockman actually confirms that, yes, giving the devil Bill Barr his due, Barr was on to something when he called certain cities "anarchist jurisdictions":

The Truth About Today’s Anarchists

“Insurrectionary anarchists” have been protesting for racial justice all summer. Some Black leaders wish they would go home.

According to Stockman, Antifa isn't just an idea. It's a thing, and a highly organized thing--as anarchic things go. She begins her story with an unemployed photographer, Jeremy Lee Quinn, snapping photos of peaceful protests that somehow continually devolved into riots and looting. Quinn noticed that mysterious black clad whites kept showing up and instigating the events. Curious, Quinn decided to don black himself and find out what was up with that. Here's excerpts of what he learned:

Chris Wray Challenges Bill Barr

No, actually I'm not referring to Wray deprecating the use of the word "spying" to describe the spying that the FBI engaged in. I'm referring to a breaking story by John Solomon that is stunning in its implications: Steele's stunning pre-FISA confession: Informant needed to air Trump dirt before election.

Here's the short story--you can get the gist of it from these notes that Kathleen Kavalec, Deputy Assistant Secretary of State, sent on Oct. 13, 2016:

UPDATED: Uh-Oh! More On Kathleen Kavalec's Notes Re Chris Steele

This is awkward. Just over a week ago Chris Wray's FBI retroactively classified Deputy Assistant Secretary of State Kathleen Kavalec's email, based on notes regarding her meetings with Chris Steele, the Brit ex-spook of "dossier" fame. Then just two days ago, John Solomon revealed the scam--it turns out Kavalec had classified her email as ... Unclassified (Chris Wray Challenges Bill Barr). And now Solomon has a new article out in which he provides some details about what's behind all those redactions, based on the notes. The email as obtained by Citizens United looks like this:

You could say, just from the title of Solomon's article, that he's skeptical of the FBI's "narrative": FBI's Steele story falls apart: False intel and media contacts were flagged before FISA. Here are some of the details that Solomon reveals, after carefully noting that the FBI had sworn in its FISA application that Steele’s “reporting has been corroborated and used in criminal proceedings” and the FBI has determined him to be “reliable” and was “unaware of any derogatory information pertaining” to him.

... Kavalec apparently needed just a single encounter with Steele at State to find one of his key claims about Trump-Russia collusion was blatantly false.
In her typed summary, Kavalec wrote that Steele told her the Russians had constructed a “technical/human operation run out of Moscow targeting the election” that recruited emigres in the United States to “do hacking and recruiting.”
She quoted Steele as saying, “Payments to those recruited are made out of the Russian Consulate in Miami,” according to a copy of her summary memo obtained under open records litigation by the conservative group Citizens United. Kavalec bluntly debunked that assertion in a bracketed comment: “It is important to note that there is no Russian consulate in Miami.”

Ouch! Standards for judging informant reliability at the FBI seem to have fallen.

K. T. McFarland On Who's In 'Big Trouble'

Former national security official K. T. McFarland went on Fox this morning with Sandra Smith, who interviewed McFarland about recent activity on the part of the GOP controlled Senate: Lindsey Graham's release of damning FBI notes that show the FBI misled the Senate Intelligence Committee and Ron Johnson's subpoenas to the FBI and Director Chris Wray. Along with the usual talk, McFarland made some important points that should help to maintain perspective as we hear about all the important players in the Russia Hoax getting a pass.

Smith first asks McFarland about the documents that Senator Ron Johnson has subpoenaed from the FBI (as well as Director Chris Wray). McFarland goes over the items that we've all heard about on the news--the documents that were turned over to the IG, the Crossfire Hurricane documents. Then she turns particular attention to a third category of documents, which I hadn't heard were subpoenaed:

But interestingly, he's also asked for all documents that the GSA--Government Services Agency, General Services Agency [sic, it's actually General Services Administration]--had collected during the transition into the Trump administration and asked for what documents were there. I mean, what documents were turned over to whom? Who was turning them over to the FBI? So when I'm looking at this for those three requests, I think some of this is indicating that they're also looking at the Mueller investigation. Not just at incompetence at the FBI or potential wrongdoing.

I've been maintaining exactly that, that AG Barr and John Durham are definitely focusing on Team Mueller from a number of angles. Recall: You can't investigate Crossfire Hurricane without also investigating Team Mueller, which was a continuation of Crossfire Hurricane. The same goes for the Flynn case.

Now, the GSA documents that McFarland is referring to were the very first group of documents that Team Mueller went after. It was a very controversial and aggressive move on Team Mueller's part, because these were documents of the Trump transition team, not the Trump administration, and GSA simply turned them over to Team Mueller without informing the Trump administration. It was a typical Andrew Weissmann and inside the DC establishment move. One angle that Durham could be looking at might be whether Weissmann, in demanding these documents from the (all too willing to cooperate) GSA, may have misrepresented his official authority to obtain those documents without process or notification to the persons and the entity that created those documents.

In my opinion, the fact that the Senate is looking at this event does, indeed, mean that they're looking at Team Mueller. But I think you can take this to the bank as well: The Senate wouldn't be doing this unless they knew that Barr and Durham had already done so.

McFarland continues:

In any event, I think Christopher Wray is in big trouble. Because, Sandra, he did one of three things. He either knew what was going on in the FBI and he uncovered it--and he kept it covered, y'know, cover it up. He, secondly, didn't want to know, and so he's just sort of, 'Don't tell me about it, I don't wanna know.' Or, he's just completely incompetent. I mean, either way, all three of those are pretty bad indictments against the current FBI director.

Assuming Trump is reelected--Wray is unceromoniously fired. My opinion.

Sandra then pivots to disgraced former FBI Director, James Comey, noting that McFarland also thinks that Comey is in 'big trouble'. McFarland responds:

Yeah, because, not just particularly with this subpoena that you just referred to, but it's the testimony that's happened in the last couple of weeks. So you had Sally Yates saying last week, 'Well, the FBI Director, Jim Comey, he went rogue--I didn't know what he was doing.' And then Rod Rosenstein, who testified a couple of weeks ago, he was the Attorney General, acting Attorney General, he said, 'I didn't know anything about it, I would never have signed those requests coming from the FBI if I knew now what I knew then [sic].' And so Comey has a lot to answer for. Either he was rogue and he was running a rogue operation in the FBI--Comey, McCabe, and his senior officials--or he's being set up to take the fall, if in fact it was not a rogue operation, if it has origins that were higher up.
And the other thing, Sandra, to remember, is that Susan Rice wrote herself a memo for the record on Inauguration Day, saying, 'President Obama wants everything done exactly by the book.' So, in other words, 'Jim Comey, if he does something that's not by the books, it's not on us!'

If you watch the video, you can tell from McFarland's body language that she doesn't necessarily believe Yates and Rosenstein, but whether they're telling the truth isn't the real issue. The point is simply that nobody's going to bat for Jim Comey, nobody's arguing--as Chris Swecker recently did--that, gosh, it's so hard to prove intent. They'd all be happy to have Comey take the fall. And, in fact, if he turns out to be the fall guy he'll certainly have earned the distinction. But I think Durham's looking at others, too.

The interview ends up with some general remarks riffing off Lindsey Graham's call for people at the FBI--or who were formerly at the FBI--to go down. IMO, McFarland's remarks here will resonate with any jury, and that dirty cops will receive no sympathy:

Now what we're finding out, whether they lied to the FISA court, whether they lied to Senator Graham, whether they lied to even President Trump, or that they lied to the American people--there were documents being falsified, there were people who were lying, senior officials of the FBI. And I think Lindsey Graham is saying, 'I wanna get to the bottom of it.' These are actual crimes. This is not just leaks to the media. These are actual crimes where people knowingly lied to other government officials and to people.

UPDATED: "A Real Attorney General"

If you haven't watched this interview with Devin Nunes, it's a must view. Nunes is clearly worked up and more plain spoken than I've ever seen him.

In response to segments of the Bill Barr interview with Fox News, in which Barr says that he has more questions now about the Russia Hoax than when he first started as AG, and that the questions he's received are inadequate, Nunes points out that the same is true for the House. For example, he says, just this week, even today, they've finally seen interagency emails regarding Christopher Steele--emails that "the FBI" (he means "Chris Wray") had hidden from Congress.

How did we just find out about this [the Kavalec email]? ... I think what you're seeing is, you're seeing a real Attorney General, a professional, and someone who's not gonna take this poisonous garbage [started by the Dems, and still pushed by irresponsible Dems and their media allies.]

I think I get it. Jeff Sessions wasn't a real Attorney General, nor was Rod Rosenstein. If Devin Nunes knows this, count on it: Bill Barr sure knows it. And I think he's telling us that Barr told Chris Wray how high to jump. When opportunity offers, Wray will be gone. Barr doesn't want to go through another confirmation just now, but if Wray wants to leave, it'll be: Hey, don't let the door hit you in the ass on the way out. In the meantime, he's got him on a leash--a short one.

As for Barr not shying away from the word "spying"?

Sandra, it's ridiculous. Every American out there knows what spying is. This [objecting to the "S" word] is all about narrative building by the Left to cover up what they did, and you have accomplices in the media. This is foolishness. ... He [Barr] used to work at the CIA, for God's sake. I've never seen something so ridiculous, where the media is culpable for this nonsense. Everybody in the media oughta be laughing at these politicians ... It's a joke, it's a joke.

Director Wray Speaks, President Trump Responds

It's all fairly self explanatory:

Why Wray thought it would be a good idea to take on Donald Trump publicly is anyone's guess. The response he received will do nothing for Wray's standing within the organization he's supposed to be leading:

I like Don Surber's take:

The inspector general's report came out and showed the FBI lied repeatedly to get permission to spy on Donald John Trump's campaign.
Instead of remorse, the fellow who headed the FBI at the time celebrated.
He tweeted, "So it was all lies. No treason. No spying on the campaign. No tapping Trumps wires. It was just good people trying to protect America."
Another lie. Jimmy the Weasel Comey has no shame. His successor also has no shame. The good news is President Trump likely will cashier the man.

Maybe Wray wants to be fired.

Is Kama Sutra Harris A Domestic Terror Threat?

Yesterday we noted the FBI "study" that identified conspiracy theories as "very likely" to "emerge, spread, and evolve" and to inspire acts of domestic terror. We noted that perhaps the conspiracy theory that is the most well documented as false is in fact the Russia Hoax, yet it went unmentioned in the FBI "study". (Is It Possible The FBI Genuinely Believed The Russia Hoax?) In the aftermath of the Dem debates on Wednesday night we once again saw how deeply the Russia Hoax has sunk into the Dem soul.

As has been widely reported, Kama Sutra Harris, Michelle Obama's candidate, was unceremoniously thrashed by Tulsi Gabbard. Smarting from her public humiliation, Kama Sutra had her  press secretary, Ian Sams, claim that the “Russian propaganda machine” was promoting Gabbard:

‘The Russian propaganda machine that tried to influence the 2016 election is now promoting the presidential aspirations of a controversial Hawaii Democrat,'” he tweeted. And retweeted.

We've already seen over the past three years that Dem anti-Trump conspiracy theories--most prominently the Russia Hoax--have driven "both groups and individual extremists to carry out criminal or violent acts.” Yet Chris Wray's FBI shows no concern for this "growing threat that seems likely to emerge, spread, and evolve, and likely to increase during the 2020 election cycle." Wray even denies that Antifa is a coordinated movement.

Obviously Bill Barr is busy tracing this pernicious Russia Hoax conspiracy theory to its source, yet how can he do so with his investigative arm, the FBI, seemingly in the grips of conspiracy theorists who are blind to what's going on before their eyes in the Dem party? Time to take action! Chris Wray has wasted space on the 7th floor of the J. Edgar Hoover Building for far too long. It's past time for him to be gone so that productive use can be made of the space he's been occupying.

ADDENDUM: Don Surber comments:

Remember that girl in elementary school who said the Russians ate her homework? That little girl was she.

UPDATED: Barr Has A Responsibility To Act

On Fox this morning President Trump called on AG Barr to "act and act fast":

"This is major corruption and this has to be known about before the election," said Trump in an interview on "Fox & Friends." "We have got to get the attorney general to act. He’s got to act and he’s got to act fast, he's got to appoint somebody" the president added.

When asked how his campaign is going, he replied "It's just going very well," adding of Biden: "I think he’s imploding, you look at all that corruption in his family, tremendous corruption."

I'm personally opposed to "appoint[ing] somebody." Investigating criminality is what we have a Department of Justice for, and there's no need to "appoint somebody"--there's an appointee, confirmed by the US Senate, already in place. Trump is just repeating what the House GOP has said. That's fine for political effect, but not as policy--we've seen enough of the abuses involved in special counsels and special prosecutors.

However, as in so much involved with the "resistance" coup efforts against our constitutional order, we're in uncharted waters here.

If this were a matter simply of allegations, ginning up an investigation would seem to be an abuse--just like Crossfire Hurricane was. Sauce for the goose and for the gander as well!

But this doesn't appear to be a case of simply politically motivated allegations in the heat of a campaign--although these events are unfolding in that context. There are several differences:

UPDATED: FISC Order In View Of OIG FISA Report Findings

Today the Foreign Intelligence Surveillance Court (FISC) issued a rare public order in response to OIG's FISA report which detailed FBI bad behavior in submitting FISA applications with regard to Carter Page. The actual title of the FISC order is:

IN RE ACCURACY CONCERNS REGARDING FBI MATTERS SUBMITTED TO THE FISC

The order begins with a brief explanation of FISC procedures, as established by FISA. Follow the link if you get off on that kind of stuff.

Likely the most interesting aspect of the order comes in the concluding paragraphs, in which the FISC addresses the specific topic of disgraced FBI attorney Kevin Clinesmith's bad, i.e., criminal, behavior. The FISC, in essence, states that any application that Clinesmith worked on must now be regarded as suspect and notes that on December 5, 2019, the FISC ordered the FBI to "provide certain information" regarding applications handled by Clinesmith. The FISC intends to publish that December 5 order and gives the FBI until December 20 to submit suggested redactions--while noting that

In view of the information released to the public in the OIG Report, the Court expects that such review will entail minimal if any redactions.

Below are the concluding paragraphs that also contains the expected highminded language about the FBI doing things to make sure this never happens again and telling the FISC what those things are. IMO, the relevant Congressional committees should invite CJ John Roberts to offer any views he may have on the subject of FISA generally and the FISC in particular. Since the FISC is a creation of Congress it's hard to see what Roberts could actually do with this mess--short of declaring the FISC unconstitutional and refusing to appoint judges to participate in it.

UPDATED: Bill Barr Is Still On The Job

AG Bill Barr's impeachment by the Dem's House may be imminent, but he continues to imperturbably do his job. It's almost like he just doesn't care about anything except the common good of the American nation. Refreshing.

Item: Some jerk named Jason Charter has been arrested as an Antifa leader who was in charge of the attempt to topple Andrew Jackson. He apparently has also been identified as a ringleader in the assault on Jack Posobiec. Who thinks that if enforcement of the law with regard to Antifa were left to Chris Wray at the FBI this would be happening? I don't. What other AG of recent memory would be willing to get in the Dem House's face in this way while they threatened his impeachment?

Item: Ghislaine Maxwell, Jeffrey Epstein's groomer and procurer, has been arrested by the FBI. The indictment is said to target the years 1994-1997 (wait, who was president then?), and Techno Fog promises a thread on why those years are important.

Sean Davis asks an interesting question about the timing of the arrest:

Is it just a coincidence that a mere two weeks after Attorney General Bill Barr fired Geoffrey Berman, the U.S. attorney in the Southern District of New York, that the FBI and DOJ finally arrested and charged Jeffrey Epstein's madam?

Believe this or not, but there are actually people out there on the internet who don't believe this was a coincidence! Not only that, but the same people are asking questions like: What else was Berman holding up? Who else thinks Chris Wray never would have done anything like this, but for Barr? How many AGs never moved against Epstein's operation over the past 20 years?

Does this tell us something about why the Dems were so irate about Berman's removal?

By the way, how did Ghislaine Maxwell wind up in Bradford, NH--population 356? Was she there to see the Bement Covered Bridge, or ... what? Gotta be a story there.

In the meantime, employment numbers for the Trump recovery are stunning.

ADDENDUM: I'm not actually that interested in this case from any legal standpoint, but Jonathan Turley is--and I'll share that interest:

Maxwell's arrest could be bad news for a number of individuals including Prince Andrew. One wrinkle however is the outrageous plea deal struck by the Justice Department with Epstein that purportedly protects "co-conspirators."

Epstein Confidante Maxwell Arrested In New Hampshire
"In a surprising move, Ghislaine Maxwell, the British heiress and confidante to the late financier Jeffrey Epstein, has been arrested in New Hampshire. Maxwell’s arrest  could have a ripple effect on both criminal and civil matters ranging from the still uncertain status of Prince Andrew to a number of defamation lawsuits."
... That deal however was not lawfully executed by Jim [sic--should be Alex] Acosta who did a great disservice not only to justice but more importantly these victims. Ironically, the improper role played by the Justice Department in the case may actually help it now with any prosecution of Maxwell.
We now have the indictment. Any problem with the Acosta deal made be avoided by not just attacking the validity of the agreement, as noted, but reliance on multiple perjury counts stemming from depositions (which would not be impacted by the agreement, even if enforceable).

Six counts:

Count 1-2: Enticement of a Minor To Travel To Engage In Illegal Sex Acts
Count 3-4:  Transportation Of A Minor With Intent To Engage In Criminal Sexual Activity
Count 5-6: Perjury

Turley thinks Berman wasn't holding anything up re Epstein/Maxwell. That's very charitable of him, given the past history of unusual legal proceedings and deals in this case.

UPDATE: Well, there is a story about Bradford, NH, and Maxwell. It sounds like she may have been hiding out there, while rumors put her in Paris. Per Techno Fog:

Ghislaine Maxwell - new info from the US Detention Memo:
1) The grand jury returned the indictment on 6/29/20
2) Maxwell has 15+ bank accounts. Some hold more than $20 million.
3) Transfers of millions $$ to/from Epstein
4) Cash purchase of 156 acre NH Property in 2019

According to the detention memo:

Most recently, the defendant appears to have been hiding on a 156-acre property acquired in an all-cash purchase in December 2019 (through a carefully anonymized LLC) in Bradford, New Hampshire, an area to which sha has no other known connections.
