UPDATED: Very Brief Election Challenge Update

I made the decision that I wouldn't attempt to track all the details of the ongoing election challenges. The fact is that the election laws in each state are unique to that state--and that's especially the case with regard to precisely those provisions that cover the types of voting most susceptible to fraud: absentee and mail in voting. It's impossible for me to keep up with the developments in a truly informed way. However, there have been some positive developments that offer hope for the Trump challenges. Note that not all of these challenges are being conducted by the Trump campaign organization. Some involve the local GOP and some involve private groups or individuals (like Sidney Powell).

Here's a brief rundown of some of the positive developments. I won't claim this is an inclusive list, but here goes.

We saw last night that the Thomas More Society, through its Amistad Project, filed an emergency motion with the Wisconsin Supreme Court. Their claim focuses on absentee ballots--but that includes a variety of types of fraud. Fraudulent Biden votes, Republican ballots not counted, etc. However, a notable aspect of this motion is that it draws attention to the use of a huge amount of money from Mark Zuckerberg that funded dodgy Dem GOTV efforts (as well, most likely, as efforts to suppress GOP voting). Again, the details will vary from one state to another. What's important is that the Thomas More people zero in on the fact that the Zuckerberg millions was "gifted" to county and municipal governments. That's illegal in virtually every state in this country. In addition it appears that the Thomas More people are working closely with Brad Maynard's project that is also focusing on absentee voting irregularities. The votes involved would easily flip Wisconsin to Trump, and Thomas More appears to have Wisconsin law--and its Supreme Court--on its side.

Late today the Thomas More Society filed a similar motion in Georgia. The focus once again is on Zuckerberg's millions flowing, illegally, to county and municipal governments. As in Wisconsin, the claim is that large numbers of Biden votes were fraudulently cast, and that "tens of thousands" of Trump votes were not counted. I haven't seen the full filing, but it looks generally similar to the Wisconsin motion and I assume that, once again, they're working closely with Brad Maynard. Here's a video of Phill Kline, explaining what's up with Zuckerberg. The optics of Phill Kline fronting for the Amistad Project isnt the best. Still, this looks promising.

This article includes a video of another dodgy aspect of the Georgia election, as presented by a private internet researcher. It all adds up.

We also saw that a Nevada judge is allowing an evidentiary hearing regarding GOP charges of fraud in Clark County (Las Vegas). That hearing will be on 12/3 and the local GOP will be conducting 15 depositions in the meantime. My understanding is that one of the big issues in Nevada has to do with double voting by California residents, but I'm sure there are other issues as well. It's a very positive develop.

Finally, the Big Enchilada: Pennsylvania.

A judge in the the Pittsburgh area has enjoined the certification of the election in Pennsylvania. This is a perfect illustration of what I was saying about how complicated matters are from state to state. This injunction was issued on state constitutional grounds. The very short version is that the state constitution conflicts with a state election law, and the constitution should take precedence. Again, the focus is on absentee ballots, and a favorable result would probably flip the election to Trump.

SWC has an excellent explanation of the ins and outs in Pennsylvania with regard to this issue. Sit down while you read this, because it may make your head spin:


As I detailed in this earlier story, several individuals — led by GOP House Member Mike Kelly — filed suit in Pennsylvania state court alleging that the “no excuse” Absentee voting procedures adopted by the Pennsylvania General Assembly violate Sec. 14 of the Pennsylvania State Constitution. That provision establishes four narrow categories of “electors” who are eligible to request and vote by absentee ballot. The Plaintiffs — including two individuals who lost election contests for the United States House of Representatives and Pennsylvania House of Representatives — claim that all votes cast by individuals who were not eligible to vote under the provisions of the Sec. 14 of the Constitution, are invalid and should be removed from vote totals in all races.

The “no excuse” absentee ballot option was passed as part of Act 77. But at the same time, the legislators passed an identical amendment to Sec. 14 of the State Constitution to alter the language of that Section regarding authorized Absentee voting. The problem is that constitutional amendments must be passed in two successive sessions of the Pennsylvania Assembly, published in newspapers of general circulation in each County of Pennsylvania, and then be adopted by a majority of voters in the next general election before the Amendments become effective. The proposed amendments to Sec. 14 have only been passed in one session of the Assembly, and have never been published or voted on by the public. Nevertheless, the state government put the provisions of Act 77 into immediate effect as if Sec. 14 had been amended.


In addition, the Pennsylvania legislature is holding hearings on election fraud and today heard some blockbuster testimony. If accepted, this too has the potential--based solely on one county if I understand this correctly--to flip the election to Trump. Get the details here:

The actual details of the testimony are even hinkier than that already sounds.

UPDATE: From Rudy's testimony in PA today. Weird how the uninspected votes seem to tally up pretty closely with that unexplained gap in mail-in ballots sent v. mail-in ballots returned.



Rudy's take was this:


You have two major gaps — you have the 672,770 votes that were not inspected by anyone secretly put into the ballot box and then you have this gap that I don’t understand between the mail-in ballots. You’ve sent out: 1.8 million and the number you counted: 2.5 million!

That’s totally impossible to explain other than what some of the other witnesses were suggesting that they were basically stuffing the ballot box. I believe what happened was that they never expected to be behind by 700,000 or 800,000 votes on election night. They expected to be behind by a couple hundred thousand — in Philadelphia to steal a couple hundred thousand votes, they do it every year, that’s not going to be tough. Now you have a real big problem so you had to create mail-in ballots, you had to stretch it out for a while.


That's a helluva lotta votes to just create, even in Philly. Thus the shutdown. Without PA, no path to 270 for Biden.

  1. Mark, I am trying to get my head around the Flynn pardon. To my mind, it indicates POTUS is getting ready to concede, since if he was confident of winning, why would he pardon now - he could always wait till the last moment.

    I get that it's a humanitarian gesture to Flynn for thanksgiving, but it's a lot of ammo to give up for that (optics, ability to sue, etc.).

    Do you have any ideas why Trump would pardon Flynn now, whilst still being confident he could win the election?

    4. Because there was no other exit. The the D.C Circuit showed their corrupt intent, colluding with Sullivan to persecute Flynn. It would take another 2 year$ of lawyer fee$ to get a $upreme Ct decision, and even then it wouldn't be over. Why sit in a rigged casino any longer?

    6. One benefit of pardoning Flynn today is that it frees up Powell to concentrate on releasing her KRAKEN re: ballot/electoral fraud.

      Otherwise, it makes little sense to do it now versus 6 weeks from now, when all appeals re: the election are played out.

    7. All: This was always an option for Trump. SP just asked him to delay it so she could follow due process. The hope that Judge Sullivan would have agreed with the DOJ well before the election came and gone.

      Further, I doubt very much Flynn will be willing to mix things up at this stage of Trump's Presidency. I don't anticipate much of anything.

    8. The significance of the Flynn pardon is that it frees him up to testify about the NSA/CIA infrastructure for foreign vote monitoring and rigging. And he won't be alone is this capacity. As Powell has already stated, there are several whistleblowers waiting in the wings to blow the lid off of this entire covert black OP, which is also why she alluded to the potential need for witness protection. Once this happens, the worldwide news media will go ballistic and, as such, the compromised US media will not be able to contain the damage. When the Deep State adopted it's scorched Earth strategy, I don't think they anticipated that it could be turned back against them.

  2. Today New Neo (in her post on "Barnes on... the election fraud cases") expresses these judgements about Rudy & Sidney:
    "My personal opinion is that they are exhausted and overwhelmed by the magnitude of what happened. That makes them emotional, plus the scope of it is difficult to organize in such a small amount of time...."
    I don't know that she *knows* the above, but I don't see her as a fool.

    1. @Mouse; IMO signature matching discrepancies won't be a starter for anything. Different counties can adjust the strength of settings from what I've read, hence won't standup in court.

    But no filing from Sidney Powell today, and a Presidential pardon for Flynn.
    So much of even the conservative media is starting to talk about how important it is to expose election fraud even if it doesn’t result in a victory for Trump. Which is hogwash.

  6. Where is Bill Barr's DOJ? The Obama Administration and Mueller witch hunt spared no expense or effort in the persecution of Mike Flynn and the attempted coup to remove Trump from office via an obstruction entrapment. But now in the face of overt election fraud on a scale never before seen on the planet, DOJ/FBI hides in the closet and does nothing. Which is the greater crime; the overt theft of a presidential election or the abdication of it's sworn duty to uphold the law by Barr and his staff? There are 19 days left until the December 14th deadline. If Barr doesn't step off the sideline soon, Trump should fire him for dereliction of duty. And he would be fully justified in doing so.

    1. Barr made an under the radar trip to Chicago 11/18. Nobody knows why. The locals didn't know he was coming, nobody knows who he talked to, and DoJ isn't saying. There are big corruption cases in IL, bluest of blue states. Is someone talking? No idea. But thanks for your insider insights.

I believe that a sound argument could be made that enough fraud has taken place, with at least willful indifference, if not complicity, from State/County officials, to call into question the validity of these State governments to provide a Republican form of government, as required by the U.S. Constitution, Art. IV, Sect. 4, of which an honest plebiscite is an implicit part.

    1. That is a fascinating thought, Tom. I am sympathetic but consider the implications. It would require wholesale occupation for one. On the other hand, aggressive Voting Rights and Civil Rights act prosecutions by DOJ that might restore some semblance of rights.

  9. It may ultimately come down to the legislatures of Pennsylvania, Michigan, Wisconsin, Georgia, and probably Arizona, too.

    As I have written in multiple comments, the scale of the fraud is such that people are having a difficult time wrapping their minds around it. Were 672K absentee ballots dumped into the count in PA after it became clear Trump was going to win the state by at least 500,000 votes if they didn't do it? I wrote a comment three weeks ago that it appeared to me that the number of outstanding ballots in PA appeared to have grown substantially from what was being reported uncounted on early in the morning of November 4th. With the old numbers, and the location of the votes, it seemed to me and pretty much everyone else that Trump's lead in PA was insurmountable. However, by late in the day on the 4th, the numbers had convinced me that Biden overtake Trump at some point- a sudden infusion of 672K absentee ballots can have that effect of changing the math. I hope Giuliani has this nailed down.

    However, if it happened in PA, then it happened in MI and WI, too, and I already know it happened in GA. If the courts won't act, then the legislatures must.

      The constitution needed to strengthen the national legislature and it did so at the expense of the state legislatures.

      I'm not sure that a balance between the two is possible, but I would start by reinvesting the state legislatures with selection of senators.

    5. @Mouse, for my part, multiple reasons. GOPe, RINO, go-along-to-get-along culture, and at the end of the day: courage.

      I've finally come around to the idea that it SHOULD be the legislatures. A legal judgment has a nice ring to it, but this is ultimately a political judgment. Criminal lawsuits and impeachments can follow when more time is available.

      After reading about the hearing yesterday, I think the PA legislators have been given enough information to strengthen their resolve should they be considering such action.

  10. I am of two minds. On the one hand, if Biden could get away with such brazen fraud, maybe there's no chance of a non-Swamp candidate ever winning the Presidency again.

    On the other, as I said to one of my few remaining Dem friends/acquaintances, "if you thought Trump was bad, wait until you see the asshole we find in 2024 to avenge the lockdowns and mask mandates."

    1. One interesting point Wictor makes is that people need to stop wishing for orange jumpsuits for the miscreants. All those court cases will just tie up the justice system for decades.

      Instead, when everything is released and known, because of Trump's EO, he has the right to seize all the assets of the evildoers, and that will be that. They'll be finished.

    2. I worked forfeiture, investigating and writing up affidavits, for 2 years. Don't think it doesn't cross my mind from time to time. The standard for civil forfeiture, btw, is probable cause. You don't need to wait for a verdict or a plea.

  13. I read all 100+ pages of the Georgia lawsuit filed by Powell etal. Very strong on the ballot stuffing and absentee vote counting irregularities and outright disregard for the actual Georgia laws involved.

    Far weaker material on the Dominion stuff, though- no Kraken there that I saw. I have written it several times, the fraud was good ole ballot stuffing, and Powell's complaint does, I believe, highlight exactly what happened:

    The Democrats were cheating for weeks prior to November 3rd, and I think they failed to carry the state anyway (I suspect they did the same thing in North Carolina, but there is no Atlanta in North Carolina to make up an 80K deficit in the early hours of November 4th. You have to remember what the ground was like at 1 a.m. on November 4th- Trump was up 100k in Wisconsin, almost 300K ahead in Michigan, and almost 700k ahead in Pennsylvania. The Democrats in Georgia, I think, panicked and did really, really stupid stuff and printed off a bunch of fake abseentee ballots during the big water leak- like 96,000 such pristine ballots all for Biden.

    I think if Powell gets the discovery she wants, she and her team will be able to prove that, in Georgia alone, the Democrats created at least 250,000 fraudulent absentee ballots for Biden, and/or canned tens of thousands of Trump votes at the same time. I think the big error that is going to do them in is the extra 96,000 that they created in haste- ballots that they could no longer record as "returned" because they didn't have the ability to go back in time and fix those registers.

    1. I also read the whole lawsuit file by Powell. I'm no lawyer but I think it's a very strong case that a fair judge will have to agree with. They submitted so many parallel avenues for Trump to win that he has to get at least one of them. Just the flouting of the law where the SOS changed the absentee process in direct violation of the GA law would be enough.
      The Dominion stuff is weaker as there's no evidence, just the clear possibility of hacking. I guess the real "kraken" would only be seen if they can get the machines themselves but given there's no audit log I'm not sure what the machine would show. That's the whole point.
      Anyway I think GA will just throw the whole mess out and send the electors for DJT.

    2. That was my concern all along, too. She kept talking about her affidavit from the anonymous Venezuelan. The 'features' of the system are well known, but to get meaningful relief on this theory Trump has to show that those 'features' were REALLY USED IN THIS ELECTION and REALLY MADE A DIFFERENCE. I didn't seem much of that. Which doesn't mean it didn't happen. It's just that time is short and we need results more or less NOW.

  14. My feeling is that Powell will probably get something from the courts in Georgia, and if I were Trump's team, I would repeat this exact lawsuit in WI, MI, and PA along with NV and AZ. I think the Democrats probably didn't have to do any late night fixes in Arizona- Trump's feud with McCain put the state in play in a fair election, so not much was needed to tip it over, but I think the Democrats had the same problems at midnight on November 3rd/4th in WI, MI, and PA- Trump's lead was bigger than they expected, so some extra votes had to found on the fly- in PA, it probably required 672K new ballots to show up from somewhere, and in Michigan, probably around 200K, and in Wisconsin, 150K- all created on the evening/morning of November 3rd/4th. That will have a trail- either the ballot counts won't match (see PA), and the signatures will not match or there will turn out to no envelopes for all those votes totals I listed above- they will be absentee ballots with no corresponding envelopes. I think this why the Democrats are so adamant that no one get to look at signatures- there are none on a massive amount of those vote totals. This, by the way, is how Milwaukee got to 90% turnout- at 1 a.m. on November 4th, Milwaukee was all the Democrats had left in Wisconsin, so all the new ballots were created for that county alone in haste.

      Hard for me to erase in my mind the images of enormous Trump rallies in AZ compared to Biden no-shows...and I'm a little skeptical about lingering McCain loyalties...

  15. This also will explain the pristine ballots in Georgia- it did the Democrats no good if it took 3 days to fill out the 96,000 ballots they needed- so they mechanized the fill of the ovals in some manner. If Powell gets discovery, those are the ballots I would be looking for first.

    He was DNI - and probably knows a lot about various foreign actors that may have influenced the election.

    I don’t see Trump pardoning him now otherwise, since Trump still has a chance to continue as POTUS.

  19. Reading the Michigan complaint right now. First note- whoever did the PDF conversion on that document has never done a Word to PDF conversion before. Yikes!

    That being pointed out, however:

    The notable thing about the complaint is the story about the ballots being delivered in the middle of the night after November 3rd and again at 9 P.M. on the 4th is interesting. One of the problems that the cheaters in Michigan may have had is that there was a Senate race with a black Republican candidate- for the longest time, James ran ahead of Peters even after Biden had comfortably been put ahead of Trump. The Democrats had to keep creating new ballots after the early morning hours of November 4th precisely because they needed more ballots get Peters ahead of James enough to evade an automatic recount. Just my theory as to why the Democrats ended up having to create so many more fraudulent votes than they actually needed in Michigan- they had two races two worry about, and in the second one, they needed quite a larger number of fake votes.

    1. It's incredible to see the minions at FB and Twitter now overtly operating under the assumption they are untouchable. One would think after Cruz and Hawleys firing warning shots over their respective bows, that they would out of a morbid sense of self preservation at least be somewhat cautious in further censorship of elected representatives of Government.

      I think this points as much to their loss of control over their own platform - both people and algorithms.

      But just as Trump is a master of sleight of hand, we can't ignore the covert* work being done by the key partner to Twatter and FB: Google in its censorship - far, far more dangerous considering their market share of everything web.

    These facts coupled with the relevant affidavits is damning, but, as of now, weaker than the others assertions.

    1. I just read the Ramsland affadavit. The problem is that it is all conjecture at this point. What is actually needed to examine the ballots themselves that have the barcode and the readout for the voter to inspect. If you start finding ballots where the barcodes don't match what the voter saw, then you got your fraud proof.

      On other part of it, Ramsland states that an operator can feed in blank ballots as write ins, and then reassign the votes to whomever he wishes. You prove this by finding major discrepancies between the votes as reported, and the ballots as hand counted. This is his assertion about Michigan, but not Georgia where a hand count was conducted in a manner of speaking. However, it is now being reported that the hand count was, in a lot of the counties, just a machine count which won't pick up the alledged fraud of a mismatch between the barcode read and the visual cues given to the voter.

      All in all, I don't see how any judge can take either of these complaints and not issue some discovery to the plaintiffs. If Powell etal. are correct, there will be massive disrepancies found in all of the ballot counts unless the miscreants have been beavering away for the last 3 weeks trying to fill in the gaps, and I don't see evidence they have filled them in- they may be afraid they are being watched by someone at this point in time.

I scanned through the Michigan complaint and note that this will certainly survive any motion to dismiss under fairly applied legal standards, assuming as a judge must that all facts are true as alleged.   22. I am a lawyer but not in the US. As far as my limited knowledge of US civil cases goes, it is not usual to put all your evidence in the complaint filing. The filing should be just enough to bring the suit into discovery. This is a strategic decision, there is no need to telegraph all you have to the other side. SP attached a lot of evidence nevertheless, she said so much beforehand, for the public consumption. My view is that for the time being she withheld the bulk of "Dominion" related evidence for the former reasons. That would make sense in my view.

    1. That's an excellent point. Thanks. Powell did, indeed, explicitly say that, while noting that it wasn't necessary. And she did NOT say that she'd be putting ALL her evidentiary eggs in the complaint basket--only more than was necessary.

    1. PA would not be superfluous if the higher goal is still to get DJT to 270 and more electors which is still possible. If the complete house of cards of Joe's "biggest and most inclusive voter fraud organisation in the world" (Sleepy Joe's own words before the election) comes down, it might be shown that DJT got even more states than these and they could still be re-certified.

    On page 5, I found a glaring misstatement:

    "Dominionvoting is also dominionvotingsystems.com"

    the URL for dominion is: https://www.dominionvoting.com/
    the URL http://www.dominionvotingsystems.com/ does not bring up anything

    When you do reverse lookup on https://lookup.icann.org/lookup you will see the the www.dominionvotingsystems.com as registered in China on 2020-05-26 BUT THIS IS NOT THE SITE FOR DOMINION.

    For an electronic intelligence analyst under 305th Military Intelligence person to make such a mistake makes the rest of the testimony suspect. And easily dismissable in court.

    I hope he is not a plant to invalidate SP's filing, that would be unfortunate!

    1. .com domains are not registered "in China" but in the US. Maybe you mean that a Chinese entity is the registrant? That would not meen that it is not a company/entity of Dominion. Chinese and others have their hands deep inside Dominion.

      However the assumption that www.dominionvotingsystems.com is connected to Dominion Voting, because the name is similar is not proven by the existence of that URL (which has zero content).

      The URL whitehouse.com for example, has nothing to do with the Whitehouse (it's a xxx site)

      If you have proof of China's hands deep inside Dominion, please share it, I would like to know. thx.
